o! <br />!The height, non-transparency, and placement of this fence present safety risks. <br />o!We understand there was a near-miss with a child crossing the sidewalk of the driveway. <br />The temporary fix of removing slats from three sections of the fence on either side of the <br />driveway increases visibility for vehicles entering or leaving. While this should lessen the <br />safety risk for children, adults, and animals crossing the driveway on the sidewalk, it is <br />only a temporary solution. <br />o!We see another potential safety issue. The height, non-transparency, and placement of the <br />fence could allow someone to hide behind the fence, surprise a passer-by, and cause them <br />harm facilitated by the element of surprise. <br /> <br />3. RIGHTS and PRIVILEGES of OTHERS <br />We oppose the installation of any fencing which would restrict enjoyment of the lake by everyone who <br />resides in or visits the McCarrons Lake neighborhood. This includes both: <br />!Homeowners whose ability to use and enjoy their residences as lakeview homesthe <br />understanding with which they were purchasedwould be diminished by obstruction of the lake. <br />!The countless walkers, runners, and bicyclists who make their way around McCarrons Lake each <br /> they go. <br />All homeowners on the north side of McCARRONS PLACE WEST now have views of the lake from <br />within their homes (first-floor views) and from their backyards (ground-level views) that are virtually <br />completely restricted or partially sorather than lake views as purchased. <br />The worst-case restriction has befallen the homeowners at 257 McCARRONS PLACE WEST. From both <br />their backyard patio and all windows on the north side of their home, they can no longer enjoy a view of <br />the lake without the fence taking up the bulk of that view. <br />Prior to the installation of the six-foot non-transparent fence at 257 McCARRONS BLVD. S., all fencing <br />around McCarrons Lake was lower, open three-rail distressed wood fencing that blends in so seamlessly <br />with the environment as to go almost unnoticed. This fence stretched: <br />!The length of McCARRONS BLVD. on the south side of the lake <br />!Along Reservoir Park <br />!Along McCARRONS BLVD. on the north side of the lake, between some houses and the street <br />The six-foot non-transparent black fence now stands out in stark contrast: an unwelcoming, veritable wall <br />that extends the length of five lots of the ENCLAVE at McCARRONS LAKE. The effect is to markedly <br />damage the character of that area on the south side of the lake. Indeed, the character of the lake as a <br />whole, since the fence is visible from one or more homes on the north side. <br />In addition, we fear that allowing one property owner to install a lakeview-obstructing fence establishes a <br />dangerous precedent, which could lead to installation of more such fences and further restrictions on the <br />rights and privileges of others to enjoy Lake McCarrons. <br />Fence at 257 McCarrons Blvd. S.
