Regular City Council Meeting <br /> Monday,June 3, 2024 <br /> Page 5 <br /> Mr. Freihammer explained the property owner is responsible for that. The City <br /> does not do any current maintenance on the alley of any sort because it is <br /> unimproved. <br /> Mayor Roe thought what would be changing for property owners is essentially half <br /> of the alley would go to the north property owners and half would go to the south <br /> property owners. Half of the walkway would go to the east property owners and <br /> half would go to the west, roughly speaking, as allocated by the County. He noted <br /> that would become part of those parcels and property owned by those individuals <br /> subject to the easement for utility access. <br /> Mr. Freihammer indicated that was correct. The big thing it is clarifying is who <br /> can utilize the alley. The City has had a lot of questions asked about access and the <br /> problem is the alley is unimproved and if driving down the alley, it gets rutted at <br /> the neighbor's property,who would be responsible for fixing it. If a utility company <br /> is doing that, the City can address it through permits or working through the utility <br /> company but the general public, since it is unimproved, makes it very difficult to <br /> regulate because it is unimproved and should not be used for access. <br /> Mayor Roe explained the reason the City is proposing to vacate is because the City <br /> has no intention to use the property for an alley or put in an alley at any time. <br /> Mr. Freihammer indicated that was correct. The City does not have any alleys to <br /> maintain and never have, so the City would like to vacate this alley if possible. <br /> Mayor Roe reviewed public hearing protocol and opened the public hearing at <br /> approximately 6:52 p.m. <br /> Public Comment <br /> Mr. Trudgeon noted he received two resident emails, both in relation to Vacation <br /> Area O. Ms.Michelle Harris emailed the City Council in opposition to the vacation <br /> of the proposed property. Ms. Pauline Craig also emailed the Council in opposition <br /> to the vacation of the proposed area. <br /> Mayor Roe indicated the public hearing would start with Vacation Area D. No one <br /> wished to address the Council on this vacation. <br /> Mayor Roe explained the public hearing is open for Vacation Area O. <br /> Ms. Linda Brown, 851 Lovell Ave <br /> Ms. Brown indicated her property on Lovell had been destroyed with the walkers <br /> down the alley. She noted there is a culvert underneath these easements, and she <br /> was supposed to have a drain at the end of the Lovell property which has not <br /> happened.
