<br />REQUEST FOR COUNCIL ACTION <br />Date: 9/23/2024 <br />Item No.: 7.a. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Resolutions and an Ordinance allowing the subdivision of a parcel <br />from the west end of the Roseville Covenant Church property and re-guide and <br />rezone it for low-to-medium density residential development (PF24-004) <br />1 <br />2 Background <br />3 The subject of this application is the westernmost 120 feet of the Roseville Covenant Church parcel at <br />4 2856 Hamline Avenue.The church has no development plans for the western end of its property, but <br />5 seeks to create a parcel that can be developed by a potential future buyer. If the current application is <br />6 approved, the only effect on the church property itself would be to reduce its area by about 10%, which <br />7 would effectively increase the improvement area of the church property to an amount that would remain <br />8 under the Institutional (INST) zoning district's limit. The rest of this report is a summary analysis of the <br />9 subdivision and rezoning proposal with respect to the proposed new parcel. The full analysis by <br />10 Planning Division staff was presented to the Planning Commission and is included as Attachment 1. <br />11 <br />12 Legislative Authority <br />13 When considering a request to change the comprehensive plan guidance of a property, or its zoning <br />14 designation, or both, the role of the City is legislative; to review a proposal for its merits in addition to <br />15 evaluating the potential impacts to the public health, safety, and general welfare of the community. The <br />16 City has broad discretion when acting in its legislative capacity, such that even if a comprehensive plan <br />17 change or rezoning request is found to be compatible with the Comprehensive Plan and is otherwise a <br />18 desirable proposal, the City may still deny the request if the proposal fails to promote the public health, <br />19 safety, and general welfare. <br />20 <br />21 When considering a subdivision request, the role of the City is quasi-judicial; to determine the facts <br />22 associated with a particular proposal and apply those facts to the legal standards contained in the <br />23 ordinance and relevant state law. In general, if the facts indicate an application meets the relevant legal <br />24 standards and will not compromise the public health, safety, and general welfare, then the applicant is <br />25 likely to be entitled to the approval. The City is, however, able to add conditions to a subdivision <br />26 approval to ensure that potential impacts on parks, schools, roads, storm sewers, and other public <br />27 infrastructure on and around the subject property are adequately addressed. Subdivisions may also be <br />28 modified to provide for the orderly, economical, and safe development of land, and to promote housing <br />29 affordability for all levels. <br />30 <br />31 Comprehensive Plan Future Land Use Map Change <br />32 Given the community survey results documented in Roseville's 2040 Comprehensive Plan encouraging <br />33 development of vacant or underutilized land and the direct proximity of the subject site to land with a <br />34 Low Density Residential (LR) future land use guidance, the Planning Commission concurred with the <br />35 recommendation presented by Planning Division staff to re-guide the subject site from Institutional to LR. <br />36 <br />37 Zoning Change <br />38 The recommended LR future land use category corresponds to two zoning districts: the Low Density <br />39 Residential (LDR) district and the Low to Medium Density Residential (LMDR) district.
