ATTACHMENT 2 <br />227 318.11 REGISTRATION NONTRANSFERABLE. <br />228 <br />229 A registration is not transferable to another person, entity, or location. <br />230 <br />231 318.12 ENFORCEMENT <br />232 <br />233 A. Generally. The City may impose a fine or suspend a registration under this <br />234 Chapteron a finding that the registered business has failed to comply with an <br />235 applicable statute, regulation, or ordinance, including a violation of this Chapter. <br />236 <br />237 B.Notice and Right to Hearing. Prior to imposing a fine or suspending any <br />238 registration under this Chapter, the City shall provide the registered business with <br />239 written notice of the alleged violations and inform the registered business of its <br />240 right to a hearing on the alleged violation. <br />241 <br />242 1. Notice shall be delivered in person or by regular mail to the address of the <br />243 registered business and shall inform the registered business of its right to a <br />244 hearing. The notice will indicate that a response must be submitted within <br />245 ten (10) days of receipt of the notice, or the right to a hearing will be <br />246 waived. <br />247 <br />248 2. After receipt of a request for a hearing, the registered business will be <br />249 given an opportunity for a hearing before the City’s Hearing Officer, as <br />250 defined in Roseville City Code Section 102.01, before final action to fine <br />251 or suspend a registration. The Hearing Officer shall give due regard to the <br />252 frequency and seriousness of the violations, the ease with which such <br />253 violations could have been cured or avoided and good faith efforts to <br />254 comply and shall issue a decision to fine or suspend the registration only <br />255 upon written findings. Within 10 days of the Hearing Officer’s order, the <br />256 decision may be appealed to the City Council. <br />257 <br />258 3. If no request for a hearing is received within ten (10) days following the <br />259 service of the notice, the matter shall be submitted to the City Council for <br />260 imposition of the fine or suspension. <br />261 <br />262 C.Emergency. If, in the discretion of the City, a registered business poses an <br />263 imminent threat to the health or safety of the public, the City may immediately <br />264 suspend the registration and provide notice of the right to hold a subsequent <br />265 hearing as prescribed in Paragraph B above. <br />266 <br />267 D. Reinstatement. The City may reinstate a registration if it determines that the <br />268 violations have been resolved. The City shall reinstate the registration if the OCM <br />269 determines the violations have been resolved. <br />270 <br />271 E.
