ATTACHMENT 3 <br />185 4.Initial registration fees and renewal registration fees are nonrefundable. <br />186 <br />187 F.A copy of a valid state license or written notice of OCM license preapproval; <br />188 <br />189 318.08PRELIMINARY COMPLIANCE CHECK. <br />190 <br />191 Initial Cannabis Retailer or Lower-Potency Hemp Retailer registration shall not be issued <br />192 unless, prior to opening for operations following approval of an application for initial <br />193 registration, the applicant has passed a preliminary compliance check conducted by the <br />194 City to ensure compliance with this chapter and any other regulations established <br />195 pursuant to Minnesota Statutes, Section 342.13. <br />196 <br />197 318.09BASIS FOR DENIAL. <br />198 <br />199 The City shall not issue a registration or renewal for any Cannabis Retailer or Lower- <br />200 Potency Hemp Retailer if any of the following conditions are true: <br />201 <br />202 A.The applicant has not submitted a complete application. <br />203 <br />204 B.The applicant does not comply with the requirements of this chapter. <br />205 <br />206 C.The applicant does not comply with applicable zoning and land use regulations. <br />207 <br />208 D.If applicable, the applicant is found to not comply with the requirements of the <br />209 Act, this chapter, the building code, or the fire code at the preliminary compliance <br />210 check. <br />211 <br />212 E.The applicant is not current on all property taxes and assessments at the location <br />213 where the retail establishment is located. <br />214 <br />215 F.If applicable, the maximum number of registrations, pursuant to Section 318.05 <br />216 have been issued by the City. <br />217 <br />218 G.The applicant does not have a valid license from the OCM. <br />219 <br />220 318.10ISSUANCE OF REGISTRATION OR RENEWAL. <br />221 <br />222 The City shall issue the registration or renewal if the applicant meets the requirements of <br />223 this chapter, including that none of the reasons for denial in this chapter are true. <br />224 <br />225 318.11REGISTRATION NONTRANSFERABLE. <br />226 <br />227 A registration is not transferable to another person, entity, or location. <br />228 <br />229 318.12ENFORCEMENT <br />230 <br />RS160\\1\\975348.v7 <br />Qbhf!214!pg!745 <br /> <br />
