<br />ATTACHMENT 3 <br />231 A.Generally. The City may impose a fine or suspend a registration under this <br />232 chapter on a finding that the registered business has failed to comply with an <br />233 applicable statute, regulation, or ordinance, including a violation of this chapter. <br />234 <br />235 B.Notice and Right to Hearing. Prior to imposing a fine or suspending any <br />236 registration under this chapter, the City shall provide the registered business with <br />237 written notice of the alleged violations and inform the registered business of its <br />238 right to a hearing on the alleged violation. <br />239 <br />240 1.Notice shall be delivered in person or by regular mail to the address of the <br />241 registered business and shall inform the registered business of its right to a <br />242 hearing. The notice will indicate that a response must be submitted within <br />243 ten (10) days of receipt of the notice, or the right to a hearing will be <br />244 waived. <br />245 <br />246 2.After receipt of a request for a hearing, the registered business will be <br />247 given an opportunity for a hearing before the City’s Hearing Officer, as <br />248 defined in Roseville City Code Section 102.01, before final action to fine <br />249 or suspend a registration. The Hearing Officer shall give due regard to the <br />250 frequency and seriousness of the violations, the ease with which such <br />251 violations could have been cured or avoided and good faith efforts to <br />252 comply and shall issue a decision to fine or suspend the registration only <br />253 upon written findings. Within 10 days of the Hearing Officer’s order, the <br />254 decision may be appealed to the City Council. <br />255 <br />256 3.If no request for a hearing is received within ten (10) days following the <br />257 service of the notice, the matter shall be submitted to the City Council for <br />258 imposition of the fine or suspension. <br />259 <br />260 C.Emergency. If, in the discretion of the City, a registered business poses an <br />261 imminent threat to the health or safety of the public, the City may immediately <br />262 suspend the registration and provide notice of the right to hold a subsequent <br />263 hearing as prescribed in Paragraph B above. <br />264 <br />265 D.Reinstatement. The City may reinstate a registration if it determines that the <br />266 violations have been resolved. The City shall reinstate the registration if the OCM <br />267 determines the violations have been resolved. <br />268 <br />269 E.Automatic Revocation. Any revocation of a license issued by the OCM related to <br />270 a registration under this chapter, shall result in automatic revocation of that <br />271 registration under this chapter. <br />272 <br />273 F.All enforcement actions under this chapter will be reported to the OCM. <br />274 <br />275 318.13PENALTIES. <br />276 <br />RS160\\1\\975348.v7 <br />Qbhf!215!pg!745 <br /> <br />
