ATTACHMENT 1 <br />45 <br />46 WHEREAS, on October 15, 2024, the building official inspected the Premises and found a <br />47 significant number of serious violations of the building code, as further described in the <br />48 Inspection Report attached hereto as Exhibit 1; and <br />49 <br />50 WHEREAS, on that same day the fire inspector inspected the Premises and found a significant <br />51 number of serious violations of the building code, as further described in the Inspection Report <br />52 attached hereto as Exhibit 1; and <br />53 <br />54 WHEREAS, overall, of the 179 units in the hotel 179 contained violations of Minnesota State <br />55 Statute, the building or fire code; and <br />56 <br />57 WHEREAS, following the inspection, the Owners were notified of the violations by letter dated <br />rdth <br />58 October 18, 2024 and, based on the noted violation, were given until October 23, October 28 <br />59 and November 18, 2024 to perform the necessary corrections; and <br />60 <br />61 WHEREAS, on March 3, 2025, the City reinspected the Premises and discovered that a few <br />62 minor violations had been corrected, but none of the serious violations of the building code or <br />63 fire code had been corrected, as further described in the Inspection Report attached hereto as <br />64 Exhibit 2; and <br />65 <br />66 WHEREAS, the Roseville Building Official and the Roseville Fire Marshall have determined <br />67 that the Building in its current condition is an “Unsafe Building or Structure” as defined in <br />68 Minnesota Rules 1300.0180, and therefore, have condemned the building and ordered it be <br />69 vacated by March 24, 2025; and <br />70 <br />71 WHEREAS, specifically, the Building is unsafe in accordance with Minnesota Rules, Section <br />72 1300.0225 because: <br />73 It is a fire hazard based on fire damage to the fire-rated assemblies, and <br />74 Is in an unsanitary condition based on damaged plumbing and waste utilities, and <br />75 Is otherwise dangerous to human life given the breadth and depth of violations <br />76 observed throughout the entirety of the Premises. <br />77 <br />78 WHEREAS, the Owners were notified of the condemnation on March 18, 2025, were provided <br />79 with the basis for the condemnation, and <br />80 <br />81 WHEREAS, on March 19, 2025 SMP Hospitality LLC, on behalf of Percy Pooniwala submitted <br />82 an Appeal Application appealing the condemnation to the City Council; and <br />83 <br />84 WHEREAS, the Owner was notified on March 19, 2025 that the appeal would be heard on <br />85 March 24, 2025, and <br />86 <br />RS160\\25\\1017457.v1 <br />Qbhf!27!pg!558 <br /> <br />
