(Citizen Petition) <br />47 16.Direct the City Attorney and relevant departments to investigate ICE-related misconduct and <br />48 enforce all applicable municipal laws, including nuisance, trespass, and public safety violations <br />49(Citizen Petition) <br />50 17.Convene public oversight hearings to create a full public record of ICE activity and city <br />51 involvement (Citizen Petition) <br />52 Discussion <br />53 Below is a discussion of each item and potential policy/ordinance considerations for the City Council to <br />54 consider: <br />55 <br />56 Consider amendments to or creation of new policies and/or ordinances to limit as much as <br />57 possible DHS, ICE and associated agencies use of city property, staff and data (Councilmember <br />58 Bauer) <br />59 <br />60 No use of any Roseville resources for support of ICE, to include transport, cameras, city data, <br />61 funds, real time data requests, or information about immigration status. No city staff, including <br />62 Roseville Police, are allowed to participate in civil immigration enforcement. (Councilmember <br />63 Strahan) <br />64 Since 2017, the City has had in place Roseville Police Department (RPD) Policy 413 regarding <br />65 immigration enforcement. The policy states that the Roseville Police Department does not undertake <br />66 immigration enforcement and will at no time ask for a person’s immigration status unless it is part of a <br />67 criminal investigation. In addition, in 2017, the City Council passed resolution #14434 that dictated that <br />68 this policy cannot be changed unless with City Council approval. <br />69 <br />70 Staff has reviewed the existing policy and have suggested changes to the policy to better strengthen and <br />71 clarify the Roseville Police Department’s policy regarding immigration enforcement. <br />72 <br />73 Presently, there are no other policies or ordinances that govern the use of external agencies regarding <br />74 the use of city property, staff, and data. For the City Council’s consideration, staff has drafted a <br />75 proposed resolution and “Use of City Resources” ordinance to address those items (Attachments 3-5). <br />76 The resolution and ordinance should be considered together as the resolution provides background on <br />77 the need for the ordinance. The resolution affirms the lawful and appropriate use of city resources. <br />78 <br />79 Specifically, the draft language in the ordinance would: <br />80 Clarify the use of city personnel and resources related to the enforcement of federal immigration <br />81 laws <br />82 State that no federal, state, or local government entity is authorized to be on any city-owned <br />83 parking lot as staging area, operations base in enforcing federal immigration law without <br />84 permission <br />85 Require reporting by any city employee who has an interaction with a representative of the <br />86 Department of Homeland Security <br />87 All interactions between city staff and DHS/ICE must be documented, publicly disclosed, and are <br />88 subject to City Council oversight.
