91 <br />92 City Council directs the City Manager to train city employees, utilizing written protocols, on how <br />93 to respond to ICE, including when they are referring a situation to legal counsel. (Councilmember <br />94 Strahan) <br />95 Staff has put together written information and training for city employees on how to respond to <br />96 immigration enforcement officials when interacting with them, including elevating such interaction to a <br />97 supervisor and/or city attorney as necessary. Training was conducted on January 16 with over 40 <br />98 employees attending. <br />99 <br />100 On city website, publish guidelines for residents on what orders they must obey and what their <br />101 legal rights are, and how they may utilize RPD to safeguard their freedoms when infringed upon. <br />102(Councilmember Strahan) <br />103 Staff has posted information on the city website (www.cityofroseville.com) about immigration resources, <br />104 including a “Know Your Rights” section, the role of the Roseville Police Department and information <br />105 about the City’s policies related to immigration enforcement. As the current situation is dynamic, City <br />106 staff will update the website as the situation warrants. <br />107 <br />108 City will prohibit agents from any agency from conducting activities in the city of Roseville while <br />109 masked or without providing identifying information. (Councilmember Strahan) <br />110 Roseville Police Department officers are required to display their name (first initial and last name) and <br />111 badge as part of their uniform requirements in RPD Policy 1017 (Attachment 6). The uniform policy also <br />112 does not allow for facial coverings to be worn by officers during performance of their duties if it is <br />113 intended to conceal the officer’s identity. There are exceptions under the policy for such things as cold <br />114 weather, wearing personal protective equipment for health and safety reasons, and for tactical and other <br />115 reasons as determined by the Chief of Police. During protests, demonstrations, and other first <br />116 amendment assemblies, Policy 425 regarding First Amendment Assemblies (Attachment 7) requires that <br />117 officers at such events wear a uniform displaying department name and a unique personal identifier. <br />118 <br />119 Prohibiting external agencies from conducting activities in Roseville while masked or without providing <br />120 identification is challenging due to law and jurisdictional considerations and enforceability. As a local <br />121 governmental unit, Roseville would have no authority or jurisdiction over the federal government and its <br />122 departments and agencies. Currently, a law passed in California that prohibited the use of masks and <br />123 operating without identification is being appealed in the courts and the State of California has paused <br />124 enforcing that law. <br />125 <br />126 Beyond the legal uncertainty about banning the use of masks and operating without identification, there <br />127 are practical difficulties in enforcement by the City. Having Roseville’s police officers enforcing these <br />128 requirements will put them in a difficult and impossible position to enforce. It is not practical, especially <br />129 in the current climate, to think that our, or any local law enforcement agency, will be able to enforce an <br />130 ordinance that prohibits external agencies from wearing masks and not identifying themselves while <br />131 conducting immigration enforcement. <br />132 <br />133 At this point, staff does not recommend pursuing an ordinance to prohibit external agencies from <br />134 conducting activities in Roseville while masked or without identification due to the legal uncertainty of <br />135 such laws and ordinances and the practical difficulties for local governments enforcing such an <br />136 ordinance. <br />137 <br />138 Right of citizens to peacefully protest will be preserved, without interference by Roseville staff or <br />139 police. (Councilmember Strahan) <br />140 The City of Roseville Police Department has Policy 425 First Amendment Assemblies (Attachment 7) in <br />141 place that provides guidance for responding to public assemblies or demonstrations. This policy states <br />142 that the Police Department will not unreasonably interfere with, harass, intimidate or discriminate against <br />143 people engaged in the lawful exercise of their rights, while also preserving peace, protecting life and <br />144 preventing the destruction of property.
