<br />ORGANIZATIONAL BUSINESS
<br />Mastel moved, Wi ski seconded, that an Executive Session be established for
<br />Thursday, August 15, 1996 beginning at 7:30 a.m., for the purpose of
<br />discussing ongoing Centre Pointe litigation. Roll Call, Ayes: Wiski, Mastel,
<br />Maschka, Goedeke, and Wall. Nays: None.

<br />REPORTS AND RECOMMENDATIONS
<br />Council agreed to move Item F-5, City Council consideration of right-of-way
<br />acquisition and settlement of claim at 2801 Snelling Avenue North, to become
<br />Item F-l under Reports and Recommendations because Special Counsel John
<br />Bannigan had to leave for another meeting, and renumbering F-l, F-2, F-3, and
<br />F-4 accordingly.

<br />Maschka moved, Goedeke seconded, that the settlement claim for 2801 Snelling
<br />Avenue North be accepted as recommended by Special Legal Counsel John
<br />Bannigan and City legal counsel in the maximum amount of $250,000 for the
<br />release of any and all claims that Lido Cafe, Inc./Labalestra Partnership may have
<br />against the City of Roseville. The City additionally proposes to pay the claimants
<br />$35,000 in a lump sum, which would cover in part the reorientation of the site to
<br />the new roadway for parking lot reconfiguration. The claimant will payoff the
<br />special assessment levied for Lincoln Drive and will pay an additional assessment
<br />for work done to expand the parking lot over the vacated frontage road. Roll
