<br />22\1 <br /> <br />The measurements for side yard space or set-back shall be made between <br />the side lot line or the front line and the part of the building nearest <br />to it and shall be made on a line perpendicular to the side or front <br />lot line. The measurements shall be made at the grade level, at the <br />building, and the .comice or ie.ve projection shall not affect the <br />case unless this projection is over two (2) feet from the face of the <br />building. If the cornice or eave projection is over two (2) feet <br />an amount shalF'be added to the required space equal to the diff- <br />erence between the cornice or eave projection and two ~2) feet. <br /> <br />5-18 Driveways, when they are constructed from the public street over a <br />prr.rtion of the lot, shall be located in residential areas to conform <br />with the side yard requirements, that is, the edge of the driveway <br />nearest to the side lot line shall be five (5) feet from such lot <br />line except by special permission or by agreement with the owner of <br />the property adjacent to have said driveway nearer to said line. <br /> <br />5-19 Fences, when constructed to enclose any lot or tract of land shall be <br />located in such a way that the entire fence shall be on the property <br />of the builder thereof. Posts and framework shall be placed within the <br />property lines of the owner and the actual fencing material such as <br />wire, lumber, pickets, etc., shall be placed on the side of the fence <br />which faces the street or the adjacent property. <br /> <br />5-20 If any lot, shown on a recorded plat in the office of the Register <br />of Deeds of Ramsey County, does not have an average width of 75 feet <br />and an area of at least 10,000 square feet, no building permit shall <br />be issued for construction thereon unless the applicant for permit <br />can show to the satisfaction of the governing body that he is unable <br />to obtain additional area and/or width. In the case of such an iso- <br />lated lot, a building permit shall be issued only after the applicant <br />has furnished such subsoil samples and testings as may be determined <br />by the building inspector to be necessary for the purpose of ascer- <br />taining what type of sanitary sewage disposal can be safely installed <br />in the limited area of such lot and the inspector has approved the same. <br />For the purpose of this regulation, the building inspector may call <br />upon the State Department of Health or obtain such other expert <br />assistance as he requires. <br /> <br />5-21 No building permits shall be issued hereafter for the construction <br />of any dwelling or other buildings requiring sanitary sewer facilities <br />in any undeveloped recorded plat, the lots of which are of smaller <br />dimensions than those set out in paragraph 5-16 unless the building <br />sites shall be the size required by the provisions of said paragraph 5-16. <br /> <br />5-22 Previous to the placing of any surfacing material of a permanent or <br />semi-permanent nature on that portion of any driveway lying between <br />the edge of the traveled road or street and the property line of the <br />property being served by said driveway, the owner or builder shall <br />cmntact the building inspector for a special permit at which time <br />he shall be advised as to the grade and elevation which can be used <br />in the construction of the proposed driveway. The building inspector <br />may call upon the services of the engineer for the municipality to <br />assist in the enforcement of this provision. <br /> <br />-24- <br />
