<br />228 <br /> <br />5-23 The applicant for any permit to construct a building, which is to be used <br />as a place of business or place of assembly, shall be required prior tc the <br />issuance of such permit to satisfy the governing body that the proposed <br />building is to be constructed on property having sufficient area to pro- <br />vide off-street parking facilities for the ~ehicles of the persons who <br />shall visit such building. <br /> <br />5-24 It is not the purpose of this portion of the building code to discourage <br />the design of future subdivisions to take advantage of new ideas nor is <br />it the purpose of this code to prevent the placing of building corners in <br />their relationship with property lines in any other manner than that <br />which is specifically stated herein. The governing body shall permit the <br />development of any area in such a way as to comply with any agreements <br />made between the governing body and the developer at the time that a <br />new plat is approved and recorded. <br /> <br />5-25 Upon application by a property owner, the governing body may vary any <br />provision of this code in harmony with its general purpose and intent, <br />where there are practical difficulties or peculiar hardships in the <br />way of carrying out the strict letter of the provisions of this ordinance <br />so that the public health, safety and general welfare may be secured and <br />substantial justice done. <br /> <br />5-26 In any area where a public sanitary sewer or a public watersupply is <br />available or about to be made available, the requirements of this code <br />relative to lot widths and area as set forth in 5-20 and 5-21 shall not <br />apply. In these cases, the governing body shall establish widths and <br />areas, which in their opinion shall fit the general plan of the munici- <br />.pality. <br /> <br />5-27 When new buildings are constructed on property which can be served by <br />either a sanitary sewer, public water supply or both, the applicant for <br />such building permit shall be required to agfee to connect his building <br />to these utilities. In these cases, no permit for a well or private <br />disposal system shall be issued. <br /> <br />SECTION SIX <br /> <br />STRUCTURAL REQUIR&~NTS <br /> <br />6.1 The workmanship in the fabrication, preparation and installation of <br />materials shall conform to generally accepted good practice. Specific <br />provisions of this part of this code shall not be deemed to suspend any <br />requirements of good practice, but shall be regarded as supplementing <br />or emphasizing them, and shall be controlling. The governing body of <br />the municipality shall, as may be necessary, promulgate rules in accordance <br />with the provisions of this code, embodying the requiren~nts of such <br />generally acceptbd good practice. <br /> <br />6-2 In every dewlling house hereafter erected, there shall be at least three <br />(3) liveable rooms and the overall dimensions shall contain an area of not <br />liss than seven hundred sixty-eight (768~ square feet except that dwellings <br />having two (2) full floors may contain a '~st faoor area of not less <br />than six hundred seventy-two (672) square feet.
