<br />at the time the plat or plan is approved or disapproved, any <br />remaining balance of the deposit. The Village Council shall <br />refer two copies of the preliminary plan to the PI~~ing <br />Commission for its examination and report, shall refer one <br />copy of the preliminary plan to the Village Engineer for his <br />examination and report. The report of the Planning Commission <br />shall be due within 45 days &fter receipt of the preliminary <br />plan at a meeting of the Planning Commission, or the Village <br />Council may take action without it. The report of the Village <br />engineer shall be due within fifteen days from receipt of said <br />plan. In the event the plan involves special problems or is in <br />conflict with the Comprehensive Plan or with the Planning <br />Commission's planning studies, the Planning Commission may direct <br />its secretary to notify the owner or subdivider as to the time <br />and place of the Planning Commission's meeting, at which he will <br />be afforded an opportunity of being heard. The Village Council <br />shall approve or disapprove the plan within sixty (60) days. If <br />the Council shall disapprove said plan, the grounds for any such <br />refUsal shall be set forth in the proceedings of the Council and <br />reported to the person or persons applying for such approval. <br />Approval of the preliminary plan shall not be construed to be <br />approval of the plat. <br /> <br />(b) After approval or disapproval of the preliminary plan by <br />the Village CounCil, the owner or subdivider may, within sixty <br />(60) days thereafter, file with the Village a final plat with a <br />formal request for approval. Published notice shall be given of <br />a public hearing to be held within thirty (30) days thereafter in <br />the official newspaper of the Village. At such hearing all persons <br />interested therein may be heard and the Council may thereafter <br />approve or disapprove the pla1o. Such approval or disapproval <br />shall be given not more than sixty (60) days after the filing <br />of the plat, with a formal request for approval. The grounds <br />for any refusal to approve the plat shall be set forth in the <br />proceedings of the Council and reported to the person or persons <br />applying for such approval. Plats, after approval, may then be <br />recorded as now provided by law. At the time of the filing of <br />the plat there shall be filed an additional three (3) copies <br />thereof, together with an up-to-date oertified copy of abstract <br />or certified registered property certificate showing the title <br />to the land designated in the plat. The Village Council shall <br />refer the original and one copy of the plat to the Village <br />Engineer for his examination and report and shall also refer the <br />abstract or the registered property certificate to the Village <br />Attorney for examination and report. The engineer's and the <br />attorney's report shall be due within fifteen (15) days after <br />such reference. If the land designated in the plat requires to <br />be rezoned, a proper petition for rezoning to the precise fUture <br />use of said land shall be submitted to the Village Council at the <br />time of the filing of the plat. <br />
