<br />to the animal and proof of rabies vaccination is presented. <br /> <br />145.085. Permissible Return of Unrestrained Dog. Not- <br />withstanding the provisions of Section 145.070, if a licensed <br />animal is found unrestrained and its owner can be identified <br />and located. such animal need not be impounded but may, instead, <br />be taken to the owner. In such case, however. proceedings may <br />be taken against the owner for violation of this Ordinance. <br /> <br />145.090. Disposition of Unclaimed Doqs and Cats. Any <br />dog or cat which is not claimed within 5 days after impounding <br />may be sold, for not less than the amount provided in Section <br />145.080, to anyone desiring to purchase the dog or cat, unless <br />said dog or cat is requested by a licensed education scientific <br />institution under Minnesota Statute Section 35.71. All such <br />funds shall be paid to the City of Roseville and placed in the <br />General Fund. Any dog or cat which is not claimed by the owner <br />or sold, shall be humanely destroyed. <br /> <br />145.100. Establishment of Pound. A City pound is <br />established which shall be at such location, either within <br />or without the City, as the Council by resolution shall designate. <br />A pound master shall be appointed by the Council who shall <br />attend to the maintenance of such pound and he shall file a <br />monthly report with the Council relating to the operation of <br />such pound. The pound shall be maintained in a clean and <br />orderly manner and subject to periodic inspection by the city <br />Health Officer. <br /> <br />145.110. Muzzling. Whenever the prevalence of rabies <br />renders such action necessary to protect the public health <br />and safety, the Mayor shall issue a proclamation ordering <br />every person owning or keeping a dog or cat to confine it <br />securely on his premises unless it is muzzled so that it <br />cannot bite. No person shall violate such proclamation, and <br />any dog or cat running at large during the time fixed in the <br />proclamation may be destroyed by the police without notice <br />to the owner. <br /> <br />145.120. Vicious Animals. Whenever the Chief of Police <br />or City Health Officer determines that any dog, cat or other <br />animal has bitten any person, such animal shall be deemed to <br />be vicious for the purpose of this section. Such animal <br />may be impounded in the City pound for a period of ten days <br />or more at the expense of the owner of said animal. Except <br />for the time limit, disposition and redemption shall be in <br />accordance with Sections 145.080 and 145.090. The quarantine <br />required by this section shall not be necessary and the require- <br />ments shall be waived whenever the owner of such dog or animal, <br />immediately upon receipt of the notice referred to above, <br /> <br />-3- <br />
