<br />(7) A certificate of liability insurance shall be filed with the <br />City covering claims for damages which might arise out of the use or <br />placement of a bench in the public right-of-way, naming the City as <br />as additional insured. The minimum limits of liability shall be <br />$100,000.00/$300,000.00. <br /> <br />(8) At the request of the Public Works Director, a bench shall <br />be removed in order to permit right-of-way improvements or <br />maintenance or, if its location is deemed to be a safety hazard. <br /> <br />(9) Written permission of the owner of private property <br />immediately adjacent to a bench must be secured and filed with the <br />City. <br /> <br />(10) If the bench placement is in a Minnesota Department of <br />Transportation or County right-of-way, written permission must be <br />secured from the Minnesota Department of Transportation or the <br />County and filed with the City. <br /> <br />IV. <br /> <br />Chapter 82 of the City Code of the City of Roseville is hereby amended by <br /> <br />adding a new Section 82.140, to read as follows: <br /> <br />82.140. Newspaper Vending Machines in Right-of-Way. No <br />newspaper vending machine may be placed or maintained in a public <br />right-of-way without securing a permit from the Public Works <br />Director and the payment of an annual vending machine license fee. <br />A permit shall not be issued unless the newspaper vending machine <br />and its placement comply with the following conditions: <br /> <br />(1) A newspaper vending machine may be placed no nearer <br />than four (4) feet from the roadway curb or the edge of the roadway <br />where no curb exists. <br /> <br />(2) The maximum size of a newspaper vending machine shall <br />be four (4) feet high, two (2) feet long, and two (2) feet deep, except, <br />in the event that the newspaper vending machine is placed within <br />forty (40) feet of the corner of an intersection, the height of such <br />newspaper vending machine shall not exceed thirty (30) inches. <br /> <br />(3) No more than one (1) newspaper vending machine per <br />newspaper publisher may be placed within one thousand (1,000) feet <br />of any other newspaper vending machine of that same newpaper <br />publisher. <br /> <br />(4) No newspaper vending machine may be attached to a <br />public facility such as a utility pole, roadway sign, or fireplug. <br />
