<br />the same management and control as the rest of the establishment and has, as an <br />integral part thereof, a dining room of at least 1800 square feet. Such dining <br />room shall have appropriate facilities for seating not less than 100 guests atone <br />time. Where the guest seating capacity is between 100 and 174, at least 50 <br />percent of the gross sales of the restaurant portion of the establishment must be <br />attributable to the service of meals. Where the seating capacity is 175 or more, <br />at least 25 percent of the gross sales of the restaurant portion of the <br />esablishment must be attributable to the service of meals. <br /> <br />(b) Restaurant. A restaurant is any establishment, other than a <br />hotel, having appropriate facilities to serve meals, for seating not less than 100 <br />guests at one time and where, in consideration of payment therefor, meals are <br />regularly served at tables to the general public and which employs an adequate <br />staff for the usual and suitable service to its guests. Where the seating capacity <br />of the establishment is between 100 and 174, at least 50 percent of the gross <br />sales of the establishment must be attributable to the service of meals. Where <br />the seating capacity is 175 or more, at least 25 percent of the gross sales of the <br />establishment must be attributable to the service of meals. <br /> <br />(3) On-Sale Wine Licenses. "On-Sale" wine licenses shall be issued only <br />to restaurants meeting the qualification of Minnesota Statutes, Section 340.11, <br />Subdivision 20 and shall permit only the sale of wine not exceeding 14 percent <br />alcohol by volume, for consumption on the licensed premises only, in conjunction <br />with the sale of food. To qualify for a license under this section, a restaurant <br />must have appropriate facilities for seating at least 25 guests at a time, <br />regularly serve meals at tables to the public for a charge, and employ and <br />adequate staff. <br /> <br />(4) Club License. Club licenses for the sale of intoxicating beverages to <br />be consumed on the licensed premises may be issued to any non-profit <br />organization, duly organized under the laws of the state for civic, fraternal, <br />social, or business purposes, or for intellectual improvement or for the promotion <br />of sports, which has been in existence for more than 15 years, and any <br />congressionally chartered veterans organization which has been in existence for <br />more than 10 years prior to January 1, 1969, which shall have more than 50 <br />members, and which shall, for more than one year, have owned, hired or leased a <br />building or space in a building of such extent and character as may be suitable <br />and adequate for the reasonable and comfortable accommodations of its <br />members and whose affairs and management are conducted by a board of <br />directors, executive committee, or other similar body chosen by the members of <br />the club or its guest. <br /> <br />(5) Special License for Sunday Sales. A special license authorizing sales <br />on Sunday in conjunction with the serving of food may be issued to any hotel, <br />restaurant, or dub which has an on-sale license. A special Sunday license is not <br />needed for Sunday sales by wine license. <br /> <br />(6) Off-Sale Licenses. Off-Sale licenses for the sale of intoxicating <br />liquor may be issued in accordance with the provisions of this Chapter. <br /> <br />151.030. Application for License. <br />
