<br />=2= <br /> <br />File 65=272 Rezoning request from I~l to 1=2 by Gluek Brewing Company on some <br />properties on County Road C and Fairview Avenue. Since the motor <br />freight terminal~ heavy truck or trailer repair has been taken out of <br />1=1 districtg the petitioner stated that it would be proper to rezone <br />the property remaining in the area of Glendenning and Bruce Trucking <br />firms. Mr. and Mrs. Douhertyp Mr. Baker residing on Fairview Avenue <br />were strongly opposed to change the zoningp they complained of heavy <br />trafficg noiseD etc. on Fairview Avenue caused by the movement of <br />trucks at all hours day in and day out. They claim the traffic at the <br />intersection of Fairview wld County Road C was dangerous. Mr. Douherty <br />had reported this to all agencies. county and villagep Police Department <br />etc. but nothing is being done about it. <br /> <br />After due considerationD Membrez finally moved~ Anderson secondedp that <br />we recommend the rezoning as requested. Roll CallD Ayes (3)~ Membrezp <br />Anderson and L. O. Nelson Nays (3)D James NelsonD Linebarger and Sigford. <br />This resulting in a tie voteD the Council was so informed. <br /> <br />File 65=268 Rezoning Request from R=l to R=3 by Northern Aggregatesp Inc.D Rubel <br />Builders of MinneapolisD of property at the S.E. corner of Highway 36 <br />and Cleveland Avenue. A letter was received from the applicant in which <br />he requested a postponement in the consideration of his request for this <br />rezoning. Nelson movedD Membrez seconded to continue this matter at the <br />next regular meeting July 7. Carried by a unanimous vote. <br /> <br />A request from Lennart Nelson was made verbally for a variance of a 5 foot side yard <br />setback instead of the regular 10 foot for a home he proposes to build on a vacant <br />lot at 1145 W. County Road B=2. This matter had not been referred to the Planning <br />Commission by the Council andD thereforeD a notice of this request had not been <br />published in the newspaper and property owners within.250feet had not been notified. <br />The petitioner was informed that we could not legally consider this matter at this <br />meeting but we would consider it at our special meeting scheduled on June 2lst if <br />there is sufficient time to publish the notice and notify the property owners affected. <br /> <br />File 64~247 Terry E. DamsgardD 434 County Road B=2. Last year Terry E. Damsgard <br />requested the approval of a proposed plat of his property at 434 W. <br />County Road B=2 but he never appeared at any of the Planning Commission <br />meetings to discuss this proposalD thereforeD the approval of his pro= <br />posed plat was finally denied on March 3D 1965. The new request now is <br />to divide his property totaling a frontage of 326.70 feet on County Road <br />B-2 as follows ~ <br /> <br />The westerly pieceD on which his house is 10catedD to be 110 feet, the <br />balance of 216070 feet to be divided into two lots~ one with a frontage <br />of 116010 feetD the other 100 feet. This new proposal conforms with the <br />minimum sizes in the ordinance. TI\ereforeD Membrez moved9 Linebarger <br />seconded that it be granted. Carried by a unanimous vote. <br /> <br />It is called to the attention that certain provisions were listed in the <br />report of Lowell E. Odland>> Public Works Director, dated December 289 <br />1964>> when the first proposed plat was being cons ide red 0 It is most <br />likely that some of these provisions may have to be complied with even <br />though the new proposal has been simplified. We recommend that Mr.Odland <br />look into the matter of sewer and water connectionsD bituminous surfacingD <br />planting of trees>> etc. before final approval is granted. <br />
