<br />-3- <br /> <br />the company should inasmuch as eventually tlle residents of Ramsey County as taxpayers <br />would be paying for this necessary property on Lexington Avenue. The point of view was <br />also expressed that other commercial property along Lexington Avenue would receive damages <br />from the County for their property that will be taken for the improvement of Lexington <br />Avenue. <br /> <br />There were also some comments made by members of the Commission concerned with the overhang <br />of the canopy when the new Lexington Avenue would go in. <br /> <br />Recommendation <br /> <br />Pope Moved, Edlund Seconded, that the request for special use permit and variances <br />to setback at l721 North Lexington Avenue, by the Western Oil Company be approved with <br />the provision that setback be 30 feet from the present right-of-way and that they furnish <br />the Village a letter stating they will not make any claims for damages to the existing <br />property when the additional right-of-way for Lexington Avenue is required. <br /> <br />Johnson Moved, Demos Seconded, that the previous motion be amended to read that <br />the applicant dedicate 16.5 feet required for the new right-of-way. Roll Call on <br />the amendment: Ayes: Demos, Eagles, Johnson. Nays: Edlund, Pope, Membrez. Roll Call <br />on the main motion: Ayes: Eagles, Edlund, Johnson, Pope, Membrez. Nays: Demos. <br /> <br />Planning File 515-69 - Robert Schroeder request for variance to setback at 257 South <br />McCarrons Boulevard <br /> <br />Presentation <br /> <br />Mr. Robert Schroeder indicated that he had been forced to remodel his house and <br />that he is now requesting a variance of 20 feet from the street instead of the standard <br />30. He further indicated that there are no existing setback lines because there is no <br />neighbor to the east or to the west. <br /> <br />Discussion <br /> <br />There was some discussion as to the exact distance of setbacks on the centerline <br />of McCarrons Boulevard. The site plan submitted does not indicate the north right-of-way <br />line of McCarrons Boulevard, but merely refers to a centerline. Consequently, there was <br />a question as to the exact location of the north side of the right-of-way in relationship <br />to the existing and the proposed home. <br /> <br />Recommendation <br /> <br />Eagles Moved, Johnson Seconded, that we recommend to the Village Council that they <br />approve the request for variance to setback at 257 South McCarrons Boulevard as requested <br />by Mr. Robert Schroeder. Roll Call, Ayes: Demos, Eagles, Edlund, Johnson, Pope, Membrez. <br />Nays: None. <br /> <br />Pfanning File 516-69 - James Edlund request for rezoning from R-l and R-2 to B-1 at <br />2049 North Snelling Avenue <br /> <br />Presentation <br /> <br />Mr. James Edlund requested that he be permitted to leave the room since this <br />particular matter pertains to his property. <br />
