<br />-2- <br /> <br />~lannini File 553-69 Ardwin Fleishhacker request for rezoning from B-1 to B-2 and <br />Division of a lot at 201l North Rice Street <br /> <br />Presentation <br />1 <br /> <br />~tr. Frank Bartho, representing Mr. Ardwin Pleishhacker, stated that his client owned a <br />parcel of land on Rice and Elmer Street which i$ presently zoned B-1. He stated that this <br />tract of land is approximately 300 foot frontage on Rice Street with 195 foot frontage on <br />Elmer Street. He is requesting that this parcel of land be rezoned from B-1 to B-2 and <br />that it be equally divided into two lSO foot tracts of frontage on Rice Street. His reason <br />for this request is that the use of land in a B-2 zone is much greater than that in the <br />B-1 category. Mr. Bartho explained the surrounding zoning and land use of the area around <br />Rice Street and Elmer. He indicated that the Planning Commission and Village Council <br />recently rezoned a parcel of land to the north to B-2 in which a wholesale automotive parts <br />company is presently building. <br /> <br />Discussion <br /> <br />Mr. Robert Bockert, l73l Galtier, representing the Galilee Lutheran Church, indicated that <br />they were not specifically against commercial property zoning adjacent to church property <br />but did want to know the particular use of this property. He also had a question as to the <br />drainage problem that had been caused from the construction of the apartments in the area. <br /> <br />Mr. George Bloom, 2040 Woodbridge Avenue, indicated that he was in favor of development that <br />would improve Rice Street and assist the neighbors to the west of this property. He felt <br />that the Planning Commission should stay with the B-1 zone or at least have a very specific <br />use for the property in question. At this time the Commission members questioned the owner <br />as to whether or not he had a specific buyer of this property at this time. Mr. Fleishhacker <br />indicated that he did not have a definite buyer or definite plans for the property at this <br />time. The Commission explained that it is the policy of the Village to know the particular use <br />of land before a rezoning would take place. At this time Mr. Bartho and Mr. Fleishhacker <br />stated that if this is the policy could the Commission consider the division of the land at <br />this time. <br /> <br />Mr. D~llgren felt that this was not a wise move since a buyer may come to Mr. Pleishhacker <br />and possibly need more than 150 feet of frontage on Rice Street for a particular use. If <br />this were the case then the owner would have to come back before the Planning Commission and <br />go through the administrative processes once again. <br /> <br />With these facts in mind the Commission indicated they felt it would be best if Mr. Fleishhacker <br />would wait until a definite buyer was confirmed and then go through the rezoning and division <br />steps in that order. <br /> <br />Recommenda t ion <br />. <br /> <br />Edlund Moved, Johnson Seconded, that the request of Ardwin Fleishhacker for a rezoning from <br />B-1 to B-2 and division of a lot at 20ll North Rice Street be denied. Roll Call, Ayes: <br />Johnson, Demos, Edlund, Membrez. Nays: None. <br /> <br />Planninj File 554-69 - MYron Rozmark request for relocation of dwelling to 1937 Westwood Circle <br /> <br />Presentation <br /> <br />Mr. Myron Rozmark, the owner of the property, stated that he would like to move this home <br />from its present location on Snelling Avenue near the highway construction to the new plat <br />at 1937 Westwood Circle. He stated that he conforms to all the building code requirements <br />
