<br />.3. <br /> <br />ReCOJJD1lendat ion <br /> <br />Mr. Kellett roved and Mrs. Demos seconded, that the Commission recommend approval <br />of Rosemary .Marley's request for variance to side yard setback at 471 Centennial <br />Drive. Roll Call, Ayes: Eagles, DeJOOs, Kellett and ~1embrez. Nays: None. <br /> <br />Planning Vile 646.71 .. Victor Vik request for variance on frontage of platted lot at <br />2787 North Oxford <br /> <br />Presentation <br /> <br />Mr. Vik indicated that his son.in.1aw had owned the lot adjacent to the south and <br />when his son-in.1aw had sold the lot Mr. Vik had included 7 feet of his lot in that <br />sale because of a mixup on property lines. <br /> <br />Discussion <br /> <br />Mr. Membrez indicated that the lot of Mr. Vik's has 68 feet of frontage on Oxford <br />Street and also pointed out the requirements applicable to this situation which are <br />contained in Sections 13.020 and 13.050 of too Village Code. <br /> <br />Mr. Goldberg, Village Engineer, indicated that if the garage faces the undeveloped <br />Judith Street, that the owner should understand that the Village will not maintain <br />the proposed street and that it would be the responsibility of the home owner. <br /> <br />Mr. Null stated that he had purchased the lot to the south from Mr. Vik's son-in-law <br />and that he had purchased 8 feet and not 7 as Mr. Vik had stated and that Mr. Vik' s <br />lot is really only 67 feet in width. <br /> <br />Mr. Ziemet MlO lives in the house north of the Vik property and Mr. Mull both indicated <br />their opposition to the request. Mr. Ziemet felt that the area would lend itself to park <br />development since there is little park area in the neighborhood for the children to <br />play. Mr. Eagles suggested that perhaps it would be best if the proposed Judith Street <br />were to be vacated. Mrs. Demos indicated that she was opposed to that and felt that <br />the Village should maintain control in case the streets ever were needed. Mr. Membrez <br />expressed concem that 67 feet was awfully narrow and that the provisions of the <br />ordinance precluded approval of this application. <br /> <br />Reconmendation <br /> <br />Mr. Eagles moved and Mrs. Demos seconded, that the Commission recommend denial of <br />Victor Vik's request for variance on frontage of platted lot at 2787 North Oxford. <br />Roll Call, Ayes: Eagles, Demos, Kellett and Membrez. Nays: None. <br /> <br />Plarming File 648.71 - James Michels, Vemon DeZiel and David Ziniel preliminary plat <br />DeZiel and Ziniel Addition at 559 South Owasso Boulevard <br /> <br />Presentation <br /> <br />Mr. Michels indicated that they are seeking preliminary plat approval for the creation <br />of 9 lots from the existing three lots. The present Heinel Drive extension is being <br />construction to facilitate the development of this area. Mr. Michels indicated that all <br />nine lots exceed the minimum square footage requirements of the Village Code, but that <br />six of the proposed lots have a width of 73-1/2 feet; whereas, 85 feet is required. <br />He stated that the 73-1/2 feet width was the existing width of the lot. <br />
