<br />-3- <br /> <br />Planning File 670 - David Duncan request for variance to the side <br />yard setback at 2825 Marion Street <br /> <br />Presentation <br /> <br />Mr. Duncan indicated that he plans to expand his garage to within <br />5 feet of his side yard property line. The Village Code requires <br />a side yard setback of 10 feet. <br /> <br />Mr. Duncan presented a letter from Mr. Hoffman, his neighbor <br />adjacent to where the garage expansion will occur, indicating that <br />he had no objections to granting the variance. <br /> <br />Recommendation <br /> <br />Mr. Membrez Moved and Mrs. Demos Seconded, that the Commission re- <br />commend approval of David Duncan's request for variance to side yard <br />setback at 2825 Marion Street. Roll Call, Ayes: Kellett, G. Johnson, <br />V. Johnson, Membrez, Demos, Eagles and Pope. Nays: None. <br /> <br />Planning File 671 - Ban-Con, Inc. request for variance to side yard <br />setback at 310 Brooks <br /> <br />Presentation <br /> <br />Mr. Russ Hengen, Ban-Con, Inc. stated that because of the odd shape <br />of the lot in question, a variance was necessary. He stated that the <br />ordinance requires a 30 foot setback from side streets on a corner lot, <br />Ban-Con is requesting they be permitted to place the house to within <br />22 feet of Brooks Circle. He stated it was decided to orient the <br />house towards Brooks Avenue in order to retain a perpendicular drive <br />and to create a better yard area for the homeowner. <br /> <br />Discussion <br /> <br />Mrs. Demos indicated that the situation created by the shape of the <br />lot was far from ideal. <br /> <br />Mr. Membrez indicated that if no variance was granted that it would <br />be almost impossible for the developer to put anything on the lot. <br /> <br />Recommendation <br /> <br />Mr. Membrez Moved and Mr. Kellett Seconded, that the Commission <br />recommend approval of Ban-Con, Inc. 's request for variance to side <br />yard setback at 310 Brooks. Roll Call, Ayes: Kellett, G. Johnson, <br />V. Johnson, Membrez, Demos, Eagles and Pope. Nays: None. <br /> <br />Planning File 672 - Ban Con, Inc. request for variance to side <br />yard setback on corner lot at 280 Transit <br /> <br />Presentation <br /> <br />Mr. Hengen of Ban-Con indicated that his firm was requesting a <br />variance to the required 30 foot side yard setback on corner lot <br />
