<br />Mr. Membrez commented the Village Planner had pointed out that the parcel on which the <br />gas station is located is presently zoned B-3 and that the Planner recorrnnends that the <br />parcel also be rezoned to B-2 and that the entire B-2 zoned parcel be made a single lot <br />of record in order to insure that a single structure is constructed. <br /> <br />Mr. Lien indicated that he would not be opposed to the Planner's recorrmendation. <br /> <br />Recorrmendation <br /> <br />Mr. V. Johnson moved and Mr. Eagles seconded, that the Commission reconunend approval of <br />Kath Brothers request for rezoning from R-l to B-2 at 2425 North Rice Street, and further <br />recommends that the parcel where the gas station is currently located be rezoned from B-3 <br />to B-2 and that the entire B-2 zoned property be made a single lot of record. The rezoning <br />from B-3 to B-2 should be done at no application expense to the applicant. Roll Call, Ayes: <br />Membrez, Demos, Eagles, V. Johnson and Kellett. Nays: None" <br /> <br />Planning File 760 - Kings Court request for variance to rear yard setback at 2560 Fry Street. <br /> <br />Presentation <br /> <br />Mr. Ken Rosland, representing Kings Court, indicated that they propose to construct a 21 x <br />30 foot addition to the rear of the building to within 4 feet of the rear property line. <br />The Village Code requires a 20 foot setback. The addition to the building will be used for <br />a women's locker room and exercise room. <br /> <br />Mr. Rosland stated that it was necessary to extend to within 4 feet of the property line <br />because of the type of exercise equipnent which currently they own. <br /> <br />Discussion <br /> <br />Mr. V. Johnson expressed concern about granting a variance to wi thin 4 feet of the rear <br />property line. He indicated that the property on Snelling Avenue which is presently <br />occupied by Polar Locker and to the rear of the King's Court property could in the future <br />be redeveloped and he would not want to see the potential use of that Polar Locker property <br />be hindered by building on an adj acent lot to wi thin 4 feet of the property line. Mr. <br />Johnson thought that perhaps a variance to within 10 feet of the property line would be <br />more appropriate. <br /> <br />Mr. Kellett stated that it would be a hardship on the applicant to limit them to a 10 <br />foot setback. <br /> <br />Recommendation <br /> <br />Mr. Eagles moved and Mr. Membrez seconded, that the Corrnnission recorrmend approval of Kings <br />Comt request for variance to rear yard setback at 2560 Fry Street. <br /> <br />Mr. V. Johnson moved and Mrs. Demos seconded, to amend the motion to recorrnnend approval <br />of a variance to within 10 feet of the rear property line, Roll Call on amendment: <br />Ayes: Membrez, Demos and V.
