<br />-2- <br /> <br />Mr. V, Johnson commented that the Commission is again faced with the age old problem <br />of rezoning and not being assured that the property would be developed as proposed if <br />something should happen to Mr. Reinhardt, <br />Mr, Reinhardt indicated he could assure the Commission that the building would be <br />constructed as proposed, <br /> <br />Recommendation <br /> <br />Mr. G, Johnson Moved, and Mr, Membrez Seconded, that the Commission recommend approval <br />of Kenneth Reinhardt's request for rezoning from R-l to R-3A at 2395 North Dale Street <br />and that 10 feet of additional right-of-way be dedicated on Dale Street and that the <br />possibility of additional right-of-way needs on County Road B-2 be investigated by the <br />staff. Roll Call, Ayes: G, Johnson, V, Johnson, Kellett, Membrez, Durgin and Grauel, <br />Nays: None, <br /> <br />Planning File 848 - Country Kitchen's request for rezoning from R-l to B-2 at <br />2257 Rice Street <br /> <br />Presentation <br /> <br />Mr, Richard Ozment, Route 1, Rosemount, Minnesota, represented Country Kitchen, He <br />indicated they are purchasing approximately a four acre tract contingent on obtaining <br />the rezoning of an .8 acre parcel for the construction of a Country Kitchen on Rice <br />Street, He stated that they have no plans for the remainder of the property which extends <br />to the west of the proposed restaurant location and that they had to buy the whole parcel. <br /> <br />Discussion <br /> <br />Mr, Grauel asked where the applicant would gain access for the remainder of the property <br />to the west. <br />Mr, Ozment indicated there exists a 30 foot easement on the south side of the property <br />which could be used, <br />Mr, Membrez expressed concern about the property to the west and what is proposed for <br />development, <br />Mr, Honchell inquired as to what the elevations of the driveway at Rice Street would be <br />and how much cutting the applicant intended. <br />Mr. Ozment indicated that he did not know the exact figures, <br />Mr, Grauel stated that the applicant should be aware from the comment made, that there <br />was a deep concern on behalf of the Planning Commission on how the property to the west <br />would eventually be developed. <br />Mr, Richard Motor, 162 Minnesota Avenue indicated that he had built his home in 1956 <br />and purposefully put his living room on the second floor so that he could enjoy the view <br />from the back of his property, He stated that if this proposal were constructed that he <br />would be looking right into the rubbish dumpsters. He expressed concern that if the <br />Country Kitchen were built, the value of his home would certainly be decreased, He <br />asked that the Planning Commission carefully consider the application and attempt to see <br />his point of view, <br />Mr. Vern Johnson indicated that he would like to see the applicant attempt to develop <br />a proposal for the entire parcel of property. He stated that if the Commission were to <br />vote tonight he would be inclined to vote against the proposal as it stands, <br />Mr, Grauel commented that he was concerned about the elevation of the proposed building <br />and the elevation of the driveway in relationship to Rice Street, He stated that ideally <br />it would be nice to include the property to the west and also the property to the south <br />in an overall development plan, but at this point it is very indefinite when the property <br />on the south would become available. <br />Mr, Dahlgren stated that part of the property which the applicant owns to the west of <br />the proposed restaurant site is zoned B-l, He commented that perhaps the applicant could <br />
