Johnson moved and Mr. Rukavina seconded that the Conmission recommend approval
of Mailand and Johnson's request for special use pennit and variances at 1045 Larpenteur
Avenue with the following conditions:

l. That if additional parking spaces are needed, as determined by the City, that
the owner will construct such spaces.

2. That the building be setback 80 feet from the property line on Dionne Street.

Roll Call, Ayes: G. Johnson>> V. Johnson, Kellett, Rukavina, Mistel, Cushing and
Grauel. Nays: None.

Plarming File 913 - William Kugler request for variance to rear yard setback at
1124 and 1144 Dionne

Presentation

Mr. Kugler proposes to construct five double garages within two feet of the rear yard
property line and to construct an addition to the existing museum to within two feet
of the rear yard property line. The required setback in both cases is 20 feet. He
indicated each of the double garages would be 22 feet x 20 feet. The garages would
se!Ve the apartment buildings owned by Mr. Kugler which were constructed in 1962. The
addition to the museum would match up with the south side of the proposed garages.

Mr. Kugler indicated that the fence is 7 feet off his south property line.

Discussion

Mr. Grauel connnented that the apartment building and the apartment building grounds
have been maintained quite well but that the fence south of the existing parking lot
and the condition of the exterior of the museum is quite poor.

Mr. Kugler indicated that he did not think the museum would be there much longer. He
stated that perhaps two or three years and then it would be moved.

Mr. Ken Christenson indicated that the property is in a state of disrepair.

Mr. Dave Blankenship who owns property north of Mr. Kugler stated that he was not
opposed to the proposed garages but was concerned about where Mr. Kugler will put his
snow during the winter. He was concerned that it would be placed on the spruce trees
on his property.

Mr. Kugler said he has plenty of space to put the snow on his own property.

Mr. Dahlgren conmented that the alley to the south of Mr. Kugler's property was not
a public alley but was privately owned by the shopping center owner. It is the responsi-
bility of the center owner to remove the snow and that legally he could not place it on
Mr. Kugler's property.

Mr. Grauel commented that since the museum will be moved in the near future, that to
build the addition on the museum at this time would not be in the best interests of
the property owner or the City.
