Nays: N:>ne. <br /> <br />Planning File 1072 - Fobert Dustin's request for vacation of right-of-way at <br />986 Millwood <br /> <br />Presentation <br /> <br />Mr. Krarrer explained that this application was actually the result of many discussions <br />held between the Public Works Depa.rt:rrent, the applicant, and the City Attorney's office. <br />'!he property as it presently exists has only infinitesimal frontage at the intersection <br />of Millwood and Chatsworth and would not have been allcwable as a buildiIlg site. 'Ihe <br />previous property owner had petitioned the City to investigate various al temati ves of <br />providing access to the property. 'Ibis was later presented to the Council with three <br />alternatives known as Project 77-20 It was indicated that the Council chose to order in <br />the shortest alternative, that being a bulb to be constructed at the intersection of <br />Millwood and O1atswarth at a cost of around $5,0000 <br /> <br />Further discussions were held with the City Attorney's office and it was felt that if <br />the applicant could vacate one half of the road right-of-way, this would then accrue to <br />the property giving the necessary frontage and eliminating the need for the road oon- <br />struction project. <br /> <br />Mr. Kraner indicated that the staff further reoo~ded that should this be done, the <br />applicant should grant a 30 foot roadway easeIrent back to the City so that the City <br />would still have the ability to construct the street at a future date. <br /> <br />Reccmrendation <br /> <br />Mr. Sim::>ns roved am Mrs. Cushing seconded, that the Carmission recarmend approval of <br />Robert Dustin! s request for vacation of right-of-way at 986 Millwood subject to the <br />condition that a 30 foot roadway easetrent be granted the Cityo Roll Call, Ayes: G. <br />Johnson, Mastel, Kellett, Cushing, Sim::>ns, V. Prese!ritation <br /> <br />Mr. Barry Satterlee of Sussel Carpany, Inc., indicated that presently the applicant's <br />hare is located in excess of 120 feet from County Road B-2. 'Ibe applicant has a back <br />yard of only approximately 6 feet and is proposing to construct a 22 x 24 foot garage <br />approximately 96 feet fran County Foad B-2o 'Ihe cwner of the property indicated that <br />after the garage is oonstIucted am once financing becares available, he plans on con- <br />structing a new hare closer to County Focrl B-2 in front of the proposed garage. He also <br />indicated that he plans on using the existing garage for storage as be existing hare does <br />not have a basetrent. <br /> <br />Recomrendation <br /> <br />Mr. Kellett ItDved and Mr. Sim:>ns seconded, that the Camrl.ssion reccmrend approval of <br />John Jaeger! s request for variance to place a new garage in front of an existing hone at <br />996 West County Road B-2, subject to the condition that once the new hOl'l'e is oonstructed, <br />the two existing structures be reItDved.
