He indicated that because <. .Jncern had been expressed <br />by the City about the possibility of the outlot going tax forfeit, that a dOC1..1Inent <br />had been prepared ensuring that wouldn't happen. He presented a draft of a <br />~claration of Covenants, Restrictions and Easerrents which would be registered <br />with the title of theproperties so that all five lots \vould sha:-r::ein the m3.intenance <br />of the outlot. The Declaration provides that taxes and rraintenance m:mies would be <br />escrowed. <br /> <br />Discussion <br /> <br />Mrs. Lucille Eng, 2250 r1idlothian Road, stated that she was concerned about the <br />lighting, fencing and screening. <br /> <br />Mr. 'Ibm Johnson, representing Darrell Farr, indicated that the light standards <br />proposed to be used would be 10 feet high and the lights would be of low wattage. <br />He also stated b'1at a landscaping plan has been submitted and that the landscaping <br />would be completed as proposed. He stated that there will be over $20,000 invested <br />in the landscaping. <br /> <br />Hr. Gere indicated that the 50 foot easerrent on the east side of the property would <br />be maintained and that the existing trees \"lould be preserved in that area. He <br />also indicated that there would be berms constructed in the 50 foot easement. <br /> <br />~.'lr. Gere stated that no part of the driveway from County Road B would be within <br />the 50 foot easerrent area. <br /> <br />Nr. Tom Johnson indicateq that a fence 4 to 6 feet high would be constructed on <br />the east side of the parking lots to the rear of the single family residences. <br /> <br />Mr. Eng stated that he felt the fence should be a minimum of 6 feet. <br /> <br />Mrs. Eng stated they did not want Laurie Road to be opened up so that it would serve <br />the cOImercial area and put that traffic into the residential neighborhood. <br /> <br />Mr. Dahlgren stated that it would be illegal to put the conuercial traffic into the <br />residential zone. <br /> <br />~Jjrs. Eng indicated that she v!ould like sorre assurance that the plantings would be <br />replaced if they did not live. <br /> <br />Mr. 'Ibm Johnson stated there would be a one season guarantee from the nursery <br />and after that the association would maintain the landscaping. <br /> <br />:Recomrendation <br /> <br />Mr. M3.stel rroved and Hr. Rukavina seconded, that the Commission recorrrnend <br />approval of Darrell Farr I s request for special use permit and preliminary plat <br />at 1711 County Road B, with the following conditions: <br /> <br />1. 'Ihat the City Planner review and approve the final plans for the <br />berros, fence and planting to assure compliance with the parking lot <br />screening requirements. <br /> <br />2. 'That the City Planner review and approve tbe final lighting plans and <br />that the light standards be no higher than 10 feet. <br />
