<br />-2- <br /> <br />funeral chapels as a special use in the R-l zoning district. The ordinance <br />has been prepared and is referred to the Planning Commission for recommendation. <br /> <br />Mr. Dahlgren indicated that the Council decision to deny the rezoning request <br />reflected their concern about the potential uses of the property for other than <br />a funeral chapel if the property was zoned B-1. He noted that the proposal for <br />adding funeral chapels as a special use in the R-l zone eliminates the risk of <br />potential other B-1 uses. He stated that if funeral chapels were added as a <br />special use in the R-l zoning district, it would mean other funeral chapels <br />could apply for a special use in the R-l zone in other areas of the city. <br />However, He felt the chances of additional funeral homes desiring to be in <br />Roseville was minimal. <br /> <br />Mr. Dahlgren suggested that if the Commission decides to recommend approval <br />of the ordinance change, it might be appropriate to define funeral chapel and <br />mortuary in the definition section of the zoning code. <br /> <br />Discussion <br /> <br />Mr. V. Johnson asked if it would be possible to word the proposed ordinance so <br />that funeral chapels in the R-l zoning districts would have to be located on a <br />major street. <br /> <br />Mr. Dahlgren responded that he felt this could be done and that the Commission <br />might want to consider including such a provision in their recommendation. <br /> <br />Mr. Ken Fabyanske, 471 Minnesota, indicated that he favors the Mueller-Bies <br />Funeral Home which would be located adjacent to his property. <br /> <br />Another resident adjacent to the proposed funeral home indicated that it was <br />the consensus of the neighbors that they would like to have the Mueller-Bies <br />Funeral Home located there and that they preferred the property remain R-l. <br /> <br />Mr. V. Johnson indicated that at this time the Commission is considering the <br />proposed ordinance. If the ordinance is adopted by the City Council, the <br />Mueller Bies firm could make application for the special use permit and the <br />Planning Commission would conduct a hearing on that specific request. <br /> <br />Mr. V. Johnson indicated that the proposed ordinance listing funeral chapels <br />as a special use, prohibits the embalming or preparation of bodies for burials. <br />He questioned whether the City could legally prohibit this activity since state <br />regulations require that the funeral home have an embalming room. <br /> <br />Mrs. Cushing indicated that she didn't see any difference whether the bodies <br />were prepared at that location or not. <br /> <br />Mrs. Dressler indicated that what had bothered her the most on the previous <br />application by Mueller-Bies was the request for the change in zoning to B-1. <br /> <br />Mr. Simons asked whether there should be some sort of criteria established <br />for uses permitted in the R-l zoning district such as uses that can be walked <br />to by people in the neighborhood. <br /> <br />Mr. Dahlgren indicated that traditionally that was the philosophy used in <br />determining the uses permitted in R-l single family zoning, such as walking to <br />churches, schools, etc. However, through the years this approach has changed. <br />
