<br />-2- <br /> <br />Discussion <br /> <br />Mr. Johnson asked what should be done concerning the platting vs metes and <br />bounds. <br /> <br />Mr. Dahlgren indicated that if the division is approved, it should be done in <br />the final plat as a plat and not as metes and bounds. <br /> <br />r1r. Rukavina asked if the applicant was aware that the development of the land <br />would require that the garage on the east be taken down. The applicant indicated <br />he was aware of this and that the garage would be taken down before development <br />occurred. He indicated that his mother currently lived on the property and that <br />no development would occur until she no longer lived there. <br /> <br />The owners of the two properties immediately to the west of the subject parcel <br />and the one property immediately to the south indicated concern over the swamp <br />area that is on their property, as well as the applicant's property. They <br />requested that the Commission give them assurance that there would be no filling <br />done on the applicant's property which would in turn cause water to run into <br />their area. <br /> <br />Mr. Dahlgren indicated that, while absolute assurance could not be given, it was <br />unlikely filling would occur there because the swamp land was designated by the <br />DNR as a natural area. Additionally, filling of such proportions would require <br />Council approval and, therefore, notification to residents in the area. <br /> <br />Recommendation <br /> <br />Mr. Rukavina moved and Mrs. Dressler seconded, that the Charles LeMay request <br />for preliminary plat at 360 West County Road C be recommended for approval by <br />the City Council with the following conditions: <br /> <br />1. That 10 feet of additional right-of-way be dedicated on County <br />Road C <br /> <br />2. That the division occur as a plat rather than as metes and bounds parcels. <br /> <br />Roll Call, Ayes: Cushing, Dressler, Mastel, Matson, Moeller, Rukavina and <br />Johnson. Nays: None. <br /> <br />Planning File 1320 - Rose Tree Apartments request for variance to floor area <br />ratio, required parking, and ordinance permitting <br />efficiency apartments at 655 5TH 36 <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated that the proposal is to add three efficiency units, one <br />on each floor, to the existing Rose Tree apartment structure at the southwest <br />corner of Cope Avenue. He indicated that this exact request was submitted to <br />the City by the apartment owners in November of 1979, at which time the request <br />was approved by the Planning Commission and Council. The owners did not proceed <br />with the alterations at that time and the variances have since expired. <br />
