<br />Planning Commission Minutes <br />December 2, 1981 <br />-2- <br /> <br />Mr. Honchell, Public Works Director, indicated he had talked with the <br />attorney for the property owner today, and the attorney had indicated <br />they would not be opposed to an easement for the pathway. <br /> <br />Recommendation <br /> <br />Mr. Matson Moved, and Mr. Moeller Seconded, that the Commission recommend <br />approval of 01' Mexico request for special use permit at 1754 Lexington <br />Avenue, and that the property owner be requested to dedicate lO feet of <br />additional right-of-way, or grant a 10 foot easement for a pathway on the <br />west side of Lexington Avenue. <br /> <br />Mrs. Dressler Moved, and Mr. Moeller Seconded, that the motion be amended <br />to include a condition that the size of the dance floor shall not exceed <br />150 sq. ft. <br /> <br />Roll Call on the amendment, Ayes: Matson, Moeller, Cushing, Dressler, and <br />Johnson. Nays: None. <br /> <br />Roll Call on motion as amended, Ayes: Matson, Moeller, Cushing, Dressler, <br />and Johnson. Nays: None. <br /> <br />Planning File 1351 - Carl Eng and Tommie Braddock request for vacation of <br />right-of-way at the 1600 block of Laurie Road. <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated there is an existing 30 feet of right-of-way, <br />originally dedicated for the extension of Laurie Road, on the north <br />side of the Eng and Braddock property. The right-of-way was platted <br />when it was assumed the surrounding property would be developed for <br />single-family use. That has not occurred, and there is no longer a <br />need for the right-of-way. Mr. Dahlgren indicated there is a water main <br />located in the right-of-way, and the Engineering Department recommends a <br />30 foot easement be retained for the utilities. <br /> <br />Discussion <br /> <br />Mrs. Eng indicated they would be willing to grant the easement for the <br />utilities. She stated they presently maintain the right-of-way, and use <br />part of it as a garden. Mrs. Braddock agreed with the easement. <br /> <br />Recommendation <br /> <br />Mr. Matson Moved, and Mrs. Cushing Seconded, that the Commission recommend <br />approval of Carl Eng and Tommie Braddock's request for vacation of right- <br />of-way at the 1600 block of Laurie Road with the condition that a 30 foot <br />easement be granted for utilities. Roll Call, Ayes: Matson, Moeller, <br />Cushing, Dressler, and Johnson. Nays: None. <br />
