<br />Planning Commission Minutes <br />-10- <br /> <br />Planning File 1517 - Jeff Nielsen request for division of lot and variance <br />to parking setback at 2055 Rice. <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated this request is similar to the prior request <br />and involves the same considerations. <br /> <br />Matson moved and DeBenedet seconded that the Planning Commission recommend <br />approval of Jeff Nielsen's request for Division of lot and 5 foot variance <br />to parking setback at 2055 Rice, with the following conditions: <br /> <br />I) That cross easements for parking be recorded at the time of the <br />lot division. <br /> <br />2) That the final drainage plan be subject to City staff review. <br /> <br />3) That the development be constructed as per plans dated 6/21/84. <br /> <br />Roll Call, Ayes: Dressler, DeBenedet, Johnson, Matson, !;foeller, and <br />Wiski. Nays: none. <br /> <br />Planning File lSOI - New Horizon request for amendment to the zoning COQP. <br />to allow the day care center use in the B-2 zone. <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated there is a trend toward placing day care centers <br />near the work place. Mr. Dahlgren also indicated the State has licensing <br />requirements which regulate day care centers. He indicated that he sees <br />no problem with making day care centers special permit uses in all commer- <br />cial zones. <br /> <br />Discussion <br /> <br />DeBenedet indicated he is concerned about safety, air quality, and noise <br />criteria for day care centers; and feels strongly that any review of a <br />day care center request should include an evaluation of noise, air quality, <br />and proximity to hazardous or flammable materials stored above ground. <br /> <br />Mr. Dahlgren indicated the special use permit ordinance sets out general <br />criteria the City is to review when evaluating a request for a special <br />use permit. These can include safety, air quality, noise, etc. Mr. <br />Dahlgren suggested that we should not single out day care as a use for <br />which we define specific criteria and standards. <br /> <br />Recommendation <br /> <br />Matson moved and Dressler seconded that the Planning Commission recommend <br />the adoption of an amendment to the zoning code to allow day care as a <br />special use in all Business districts and in the Shopping Center District. <br /> <br />Roll Call, Ayes: Dressler, DeBenedet, Johnson, Matson, Moeller and <br />Wiski. Nays: none. <br />
