<br />Planning Commission Minute. - December 5, 1984 <br />Page 2 <br /> <br />Wiski asked whether they were considering using the whole building for off-sale <br />liquor in the future. Mr. Thorne indicated they were not. <br /> <br />Wiski asked whether the applicant planned to complete all exterior construction at <br />one time. Mro Thorne indicated they did. <br /> <br />Mr. Drown indicated the current property line may reflect 45 feet of right-of-way on <br />County Road D. There is a need for 4.5 more feet of dedication. He indicated there <br />appears to be enough space to accomplish what the applicant wants to do after the 4.5 <br />foot dedication, although some of the northerly parking spaces would be lost. <br /> <br />Wiski asked whether all parking areas would be curbed. The architect indicated they <br />would be. <br /> <br />Wiski asked how the applicant proposed to drain the site. The architect indicated <br />drainage is to the southwest and they plan to maintain the drainage in that <br />direction. Drown indicated the proposed drainage directly off the parking area is <br />not according to normal City policy. He indicated there is no storm sewer pipe or <br />ditch in the area of the property. He indicated a solution could be worked out at <br />the staff level. <br /> <br />Wiski indicated the trash container as proposed in the southeast corner of the <br />building would be on the 20 foot easement. He asked where the trash container would <br />be placed if it could not be on the easement. ~1r. Thorn indicated he will work out <br />an agreement with the neighbor. <br /> <br />A representative of the neighbor to the east asked that the Commission continue its <br />action to allow more consideration by the neighbor 0 <br /> <br />Berry asked whether the Commission should take action without solving the question of <br />the trash container located on the easemento Matson suggested the two parties should <br />work it out between themselves, since it is a private easement. Johnson suggested <br />the trash location question should be resolved by the Commission. <br /> <br />DeBenedet indicated he was not comfortable with the parking setback variances, <br />especially the one to the north. He suggested we retain the required setbacks <br />because of the upgrading of County Road Do <br /> <br />Wiski indicated the new dedication of right-of-way on County Road D will cause the <br />loss of parking spaces to the north. The applicant should then be close to meeting <br />setbacks 0 <br /> <br />Recommenda.tion <br /> <br />Matson moved, Berry seconded that the Planning Commission recommend approval of First <br />Grand Avenue Liquors, Inc. request for special use permit for off-sale liquor store <br />and variance to allow parking to within five feet of the west side property line at <br />3114 Old Highway 8, with the following conditions: <br /> <br />1) That additional right-of-way be dedicated to provide 49.5 feet of right-of-way <br />along COtlllty Road Do <br />2) That exterior materials be approved by Staff. <br />
