<br />Planning Commission M~_ ,tes - January 2, 1985 <br />Page 2 <br /> <br />Planning File 1569 - Tanurb Developments, Inc. request for rezoning, special use <br />permit, vacation of right-of-way, and variances at 2480 Fairview <br />Avenue. <br /> <br />Presentation <br /> <br />Mr. Dahlgren discussed the history of the site as it relates to the transition from <br />residential use to commercial use. He indicated the basic decision related to the <br />proper land use on the site was made when the Comprehensive Plan was amended from <br />single family residential to business. Mr. Dahlgren indicated the right-of-way <br />requirement on Fairview is 49.5 feet. <br /> <br />Mr. Dahlgren indicated the request for variances to building setback requirements is <br />due to the proposed development being a strip center rather than a mall-type center. <br />The Shopping Center zone was set up to accomodate mall-type centers such as Rosedale <br />and HarMar, which have the building in the center of the site, and parking <br />surrounding it. A strip center, with the majority of the parking in front of the <br />center, requires some modifications to the setbacks. <br /> <br />Mr. Dahlgren indicated there are several concerns which need to be addressed: <br /> <br />1. Although City staff have recommended that the applicant replat the site as part <br />of the application, this has not been done. The applicant, instead, has <br />requested vacation of the existing public right-of-way. The Commission may want <br />to condition vacation of the right-of-way on a future replatting of the site. <br /> <br />2. There may be traffic visibility problems with the access at the Mid-America Bank <br />across from the Rosedale entrance off of County Road B-2. This may require a <br />traffic signal or possibly closing this entrance to the proposed center. <br /> <br />3. The proposed plan makes it necessary that American Street slant to the southwest <br />to go around the south end of the proposed center. The property owner to the <br />south has agreed to dedicate the right-of-way required for the roadway, but does <br />not want to pay the cost of the construction of the roadway. Mr. Dahlgren <br />suggested the developer should pick up the cost of the changes to the roadway. <br />Mr. Borman, representing the applicant, indicated the applicant did not want the <br />roadway to run through their property to start with; therefore, they do not feel <br />they should have to pay for the roadway. Mr. Dahlgren indicated it was <br />initially determined that American Street run through the proposed development <br />to Fairview. The City has made concessions to accomodate the center and the <br />roadway. Mr. Drown indicated the cost of the roadway changes would be <br />approximately $20,000. <br /> <br />4. The roadway contiguous to the front of the center is too steep at its <br />intersection with Fairview. The grade should be leveled at the intersection. <br /> <br />5. There is a very steep grade at the north property line. This will be difficult <br />to maintain, and with the proposed cyclone fence, could be a litter collector. <br /> <br />6. The HVAC equipment on the east portion of the center may be visible from <br />Fairview. <br />
