<br />-3- <br /> <br />RecoTirnendation <br /> <br />r.1atson moved, Noeller seconded that the Commission reconunend approval of Ashland <br />Oil's request for special use permit and variance to setback at 2172 Lexington <br />Avenue, with the following conditions: <br /> <br />1) That the property be developed in accordance with the site plan dated January <br />22, 1985. <br />2) That an additional ten feet of right-of-way for County Road B, and 16 feet, <br />six inches of right-of-way for Lexington Avenue be dedicated. <br />3) That the staff review the need for a fence on the north property line adjacent <br />to the apartment building, and evaluate whether a species of tree other than the <br />proposed SUgar f-1aple should be used. <br /> <br />Roll Call, Ayes: Johnson, Matson, Moeller, Berry, DeBenedet, Dressler and Wiski. <br /> <br />Nays: None. <br /> <br />Planning File 1570 - AI Kehr request for rezoning from R-I to R-2, special use permit <br />for Planned Unit Development, preliminary plat and var iance <br />to density at 674 County Road C. <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated r.1r. Kehr is applying for a rezoning to permit the construction <br />of thirteen townhouses. The proposal is the same as considered by the Commission and <br />denied by the Council last f1arch, except for the change of increasing the dimensions <br />of the corner of the L-shaped private road. The increase in size is proposed to <br />allow fire trucks to turn around. Mr. Dahlgren commented there is a 2-acre minimum <br />requirement for Planned Unit Developments. Mr. Kehr's property is a little less than <br />2 acres. He stated the City has approved other PUD's of less than 2 acres and felt <br />it was appropriate to consider this application. <br /> <br />!1r. Drown indicated the water system serving Hr. Kehr' s property should be looped <br />with a proposed system scheduled for construction in 1986 in the park to the south. <br />There is also a need for a sidewalk along County Road C. <br /> <br />Mr. Pope, architect representing Hr. Kehr, stated it was his opinion the revised <br />corner will meet the needs of a turnaround for fire trucks. <br /> <br />Hr. Pope indicated the plan shows the possibility of extending the private roadway to <br />the east. Michaels Construction Company and Belair Construction Company have <br />indicated interest in developing property to the east of l4.r. Kehr' s. <br /> <br />Discussion <br /> <br />Hr. Kehr stated he had no objection to extending the water line to the south prop=rty <br />line for future looping. <br />
