<br />Page 5 <br /> <br />Recommendation <br /> <br />DeBenedet moved, Johnson seconded that the Commission recommend approval <br />of Metropolitan Recovery Corporation application for rezoning from 1-2 <br />to 1-2a and special use permit at Rose Place, with the following <br />conditions: <br /> <br />1) That the facility construction and operation shall be in accordance <br />with regulations and approvals of the Minnesota Pollution Control <br />Agency. <br /> <br />2) That the development and operation shall be in accordance with <br />application, drawings and data as submitted by the applicant and <br />dated March 1, 1985. <br /> <br />3) That the applicant provide environmental impairment insurance in an <br />amount no less than $5,000,000. <br /> <br />4) That the width of the entrance driveway be reviewed with staff. <br /> <br />5) That the landscaping and engineering plans be approved by staff. <br /> <br />Dressler moved that the motion be amended by adding the following <br />condition: <br /> <br />6) That the Metropolitan Recovery Corporation agree to be responsible <br />for the cleanup of any illegal dumping within proximity of their <br />facility. <br /> <br />Motion died for lack of a second. <br /> <br />Roll Call, Ayes: Matson, Moeller, Berry, DeBenedet, Dressler, <br />Johnson and Wiski. <br /> <br />Nays: None. <br /> <br />Matson moved, Berry seconded that Metropolitan Recovery Corporation <br />application for preliminary plat at 2430 Rose Place be approved with the <br />following conditions: <br /> <br />1) That a ten foot drainage easement be provided on the east property <br />line of Lot 2. <br /> <br />2) That the sanitary sewer be extended to serve Lot 2 or that the <br />applicant deposit 1 and 1/2 times the estimated cost of the sewer <br />extension. <br /> <br />Roll Call, Ayes: Matson, Moeller, Berry, DeBenedet, Dressler, <br />Johnson and Wiski. <br /> <br />Nays: None. <br />
