<br />Pqe4 <br />Planning Commission Meeting <br />June 5, 1985 <br /> <br />Recommendation <br /> <br />Matson moved, Johnson seconded that the Burger King Corporation application for <br />rezoning from B4 to B3, special use permit for a drive through facility, and <br />variance for construction for a drive through lane within five feet of the <br />right-of-way and building within twenty five feet of the right-of-way (or <br />twenty-three foot as measured from a five foot eave). The approved would be <br />following conditions: <br /> <br />1. Burger King will construct at their cost an additional turn lane into <br />this site on Cleveland Avenue if in the opinion of the staff such a <br />facility is warranted in the future. <br /> <br />2. All construction be in accordance with the plans submitted to the city <br />dated 4/26/85. <br /> <br />Discussion <br /> <br />Mr. Wiski indicated that the site functions as one of the gateways to the city's <br />tax increment financing district and is less important to avoid traffic <br />congestion problems. Because the rezoning to B3 allows B2 uses as well, which <br />can be very heavy traffic generators and giving the limited amount of stacking <br />space on site or on Cleveland toward C, he felt the requested zoning to be <br />inappropriate and he would not support the request. <br /> <br />Mr. Matson indicated that with the power line easement on the property, only a <br />very small structure could fit on the site and, thus, the future traffic <br />generated would be quite limited. He noted that a restaurant business is a <br />quick-in, quick-out generator with users learning to get in and out of the site <br />quite quickly. He doubts there will be a significant traffic problem and supports <br />the motion. <br /> <br />Mayor Demos noted that the council considered the major entrance to the TIF <br />district at the Long Lake-County Road C intersection, and at the bridge site <br />leading from Rosedale. She noted that the proposed site is outside the <br />boundaries of the tax increment district. <br /> <br />Ms. Johnson noted that many nearby uses were restaurants or heavy traffic <br />generators. <br /> <br />Roll Call, Ayes: Johnson, Matson, Moeller, Dressler <br /> <br />Nays: Berry, Wiski <br /> <br />Mr. Miller requested that the applicant determine the legality of U turns, <br />particularly at the Long Lake-C intersection. <br />
