Mr. Matson asked what the respective problems of sharing driveways are when
owner disagreement occurs. Mr. Dahlgren replied that the deed can govern
the agreement regarding the driveway and color of house, which is the
obligation of the builder to draft such language. The City, before
granting the permit, can ascertain whether this agreement has indeed been
developed.

Roll Call, Ayes: Dressler, Matson, Berry, DeBenedet, Wiski.

Nays: None.

Planning File 1601

Terry Hurias has proposed the creation of a new lot from a metes and bounds
parcel of 163.2' frontage with a depth of 110i. Mr. Dahlgren discussed a
number of significant problems relating to this proposal, which include the
condition of the service road on the west side of the property and the
difficulties regarding extension of sanitary sewer onto the property. Mr.
Dahlgren pointed out that this request would more appropriately be
addressed as a preliminary plat which would resolve the street and sewer
problems.

Discussion

Fred Hurias, 2547
land to his son.
lot with simply a
immediately.

Snelling, proposed turning over the southern part of his
However, Mr. Dahlgren pointed out that you can't have a
garage unless a home was proposed to be built

Mr. Wiski asked the Hurias why he did not choose to properly plat the
respective parcels. Marv Hurias , 2599 Snelling, stated that there is a
sewer line that runs north on Snelling over Snelling curve on the gas line
property. Thus the sanitary sewer isn't really a problem. He also asked
what platting would potentially do to the taxes in the area.

Mr. Drown concurred with Mr. Dahlgren's concern and pointed out that in the
1970's the issue of platting in the area as brought up. In 1971, the public
works director wanted to have the area platted. Mr. Drown reiterated the
most effective way to deal with this issue is to get it platted if it is
going to be properly subdivided.

Mr. Matson pointed out that an impasse appears to exist and that the owners
don't really have development plans for the parcels.

Marv Hurias asked if the City would be willing to purchase part of the lot.
Mr. Drown stated that the City may need ponding and thus may want to
purchase some ponding easements in the area. Mr. Drown pointed out that a
study is underway in terms of ponding easements for the City and that the
schedule could be moved up and modified to analyze this particular parcel.

Gladys Thompson, 2521 Snelling Curve, stated that she liked the area as is
and it should basically remain in its natural state, although she would
support the Hurias request.
