The use is not a legal nonconforming use, as these bumpers were <br />not stored on the site until 1977. Also, when the zoning <br />district was formed in 1959, bumpers were not stored on the <br />site. <br /> <br />2. The illegal use has a deleterious impact on the adjacent <br />neighborhood and the future development in the area. <br /> <br />Roll Call, Ayes: Moeller, Goedeke, Berry, Maschka, Johnson, and <br />Wiski. <br />Nays: None. <br /> <br />Planning File 1698 <br />Joseph Coppersmith request for division of lot at 645 Transit <br />Avenue. <br /> <br />Presentation <br />Mr. Dahlgren discussed the proposed plat which would be dividing a <br />parcel into three lots. He pointed out there may be a problem in <br />that the existing house may be closer than the ten feet that is <br />required on the eastern lot line. Mr. Coppersmith stated that it <br />was his recollection that the house is approximately ten feet from <br />the lot line. He also pointed out that the garage on the site <br />would eventually be removed. <br /> <br />Wi ski asked whether Mr. Coppersmith would accept final plat <br />approval contingent upon removal of the garage. Coppersmith <br />stated that he would remove the garage when the site is sold. <br /> <br />Dahlgren stated that a problem existed in that the lot line can't <br />go through a building. Thus, the preliminary plat could be <br />approved, with the final plat approval subject to the removal of <br />the garage. <br /> <br />Terry Syring, 2455 North Dale, stated that he thought the lots <br />were extremely small for residential. The use of the lots may be <br />proper for single family homes but he stated if they were built, <br />they should be built with no variances. Mr. Syring's mother <br />stated that any developments should not negatively impact the <br />park. <br /> <br />Coppersmith pointed out that the existing lots in the area are <br />currently the size of the lots he is proposing. <br /> <br />Goedeke asked for clarification with respect to the lot lines, <br />which Mr. Janisch proceeded to do. <br /> <br />Terry Syring's mother asked what specifically Coppersmith proposed <br />to do with the lots. Coppersmith stated that eventually he would <br />sell the lots. <br /> <br />Berry moved, Goedeke seconded, approval of the Joseph Coppersmith <br />request for preliminary plat at 645 Transit Avenue with the <br />following conditions: <br />
