<br />Roseville Planning Commission Minutes <br />November 5, 1986 <br /> <br />Page 2 <br /> <br />Waldron proceeded to read the proposed resolution the City Council <br />will consider November 10, relating to the moratorium. <br /> <br />Dick Peterson, representing Mar-Len, stated that he was shocked <br />that this moratorium was occurring, and he did not expect it. He <br />was concerned that the moratorium's legal impact needed to be <br />considered. Peterson stated that the area was rezoned B-4, and <br />that this item should have been studied at a previous date. <br />Peterson stated that the moratorium should not preclude review of <br />the Mar-Len site plan. <br /> <br />Bill Elfholz stated he believes that since the area is zoned B-4, <br />this particular development is workable. If the City wants to buy <br />the building from him for the same price, within the same time- <br />frame, he would support the moratorium. <br /> <br />Peterson again reiterated that he was concerned about receiving <br />due process with respect to the moratorium. <br /> <br />James Bartlett, the new owner of the Ruan parcel, also stated his <br />concern that he could not support the moratorium. He also stated <br />his concern with respect to notification of the owners. <br /> <br />Wiski stated that when the B-4 was first used, the City was told <br />that the trucking areas would stay for a significant period of <br />time, which they now are not. He also pointed out the findings of <br />the consultant will require additional review and analysis by the <br />City. Wiski stated that in the past, a moratorium has been used <br />by the City; thus the precedent exists. Wi ski also pointed out <br />that in this case, the proposed development does not meet the <br />compatibility of use and intensity planned for the area. <br /> <br />Maschka asked as to whether a hearing for a moritorium was <br />required. Mr. Dahlgren stated the last time a moratorium was put <br />into effect it was decided in one night, and discussion <br />subsequently took place with the owners. Dahlgren pointed out <br />that the development along 35W is working well to the south, in <br />light of the proposed Rosewood project. He pointed out that the <br />companies to the north initially told him that they were set, and <br />didn't envision any changes; therefore, in light of the fact that <br />these unanticipated changes are indeed occurring, the City needs <br />more time to consider what should be done in the northern area of <br />the Tax Increment District. <br /> <br />Maschka stated his <br />owners did not sell <br />the existing capital <br />ular item, he stated <br /> <br />concerns that under the new tax law if the <br />this year, they would not get the benefit of <br />gains law. However, outside of that partic- <br />that the moritorium is probably appropriate. <br /> <br />Dahlgren <br />for that <br />problems <br />relating <br /> <br />stated that at the staff level, many times the concerns <br />area have been pointed out to Mr. Vanasse, and that these <br />were pointed out at every single planning meeting <br />to the development. <br />
