That final development and building plans are in accordance <br />with the plans submitted with the Planned Unit Development. <br /> <br />Roll Call, Ayes: <br />Nays: <br /> <br />Berry, DeBenedet, Goedeke, Johnson, and Moeller. <br />None <br /> <br />Planning File 1717 <br />Learning Tree request for Special Use Permit at 181 County Road <br />B-2. <br /> <br />Presentation <br />Dahlgren discussed the proposed development, and pointed out that <br />the site for this project and the Shelard Development are owned <br />by Dr. House. Dahlgren stated the lot is currently zoned B-2 <br />which, therefore, requires a special use for this type of <br />development. Dahlgren stated that the building would be con- <br />structed in a residential-type context to blend in well with the <br />adjacent areas. <br /> <br />The major concern relating to this project is the private road <br />that runs east of the project and west of the Shelard project. <br />Dr. House, the owner of the properties, has an approved plat for <br />the area; however, it is in the City's best interests to be sure <br />that the private road providing access to the She lard and the <br />Learning Tree project be constructed. Mr. Krause, representing <br />Construc-tion 70 and Learning Tree, stated that they are also <br />very concerned about the street and potential delays. <br /> <br />Berry asked what would happen to the pond on the site. <br />replied that the pond would be fenced. <br /> <br />Krause <br /> <br />DeBenedet asked what the applicant's concerns were relating to <br />the road. Krause stated Learning Tree had not anticipated con- <br />struction of the street, and the street basically had nothing to <br />do with Learning Tree's plans and purchase of the property. <br />Learning Tree had anticipated entering the parcel off County Road <br />B-2. <br /> <br />Goedeke asked whether the development would meet all the setback <br />requirements. Dahlgren replied that it would. Janisch also <br />stated that the private road would essentially be a one way. <br /> <br />Johnson asked whether the construction of this private road could <br />be a condition of the approval. Dahlgren replied that yes, it <br />could. <br /> <br />Krause wanted to know how the decision of making this condition <br />would impact Learning Tree. Dahlgren replied that the private <br />road is part of an approved P.U.D., and who is going to construct <br />it must be resolved. <br />
