<br />Roseville Planning Commission Minutes <br />May 6, 1987 <br /> <br />Page 6 <br /> <br />Berry stated her concern that Code Enforcement simply would not <br />enforce the requirements. <br /> <br />Stokes stated it was his opinion it was not fair for a business <br />to be held back simply because the City can't enforce its codes. <br /> <br />Johnson replied that in her opinion, this was a small site that <br />needs more consideration. <br /> <br />Moeller replied that it is appropriate to act on the application <br />that night, particularly if the Planning Commission was concerned <br />that one of the neighbors wasn't present, because it is the <br />neighbor's responsibility to be present. <br /> <br />Roll Call, Ayes: <br />Nays: <br /> <br />Berry, DeBenedet, Goedeke, and Johnson. <br />Moeller, Maschka, and Stokes. <br /> <br />Motion carried four to three. <br /> <br />Waldron suggested that Mr. Lundquist meet as soon as possible <br />with Dahlgren, Janisch and him to reach a solution with respect <br />to this project. <br /> <br />Planning File 1744 <br />Joel and Phyllis Dillner request for preliminary plat at 2192 <br />Acorn Road. <br /> <br />Presentation <br />Dahlgren pointed out the location and the proposed site for the <br />split. Essentially two buildable lots will be created. He <br />pointed out three difficulties: one, that the driveway was too <br />close to the lot line and should be moved to meet the five foot <br />requirement; 2. a private easement for utilities across Lot B was <br />needed, and 3. that an easement for drainage to the pond is <br />required. It was also pointed out that an additional assessment <br />of $5,189 is needed. <br /> <br />Janisch stated that payment through said split becomes due when <br />the lot is split. <br /> <br />Mr. Dillner proceeded to thank Dahlgren and Janisch for their <br />assistance in the development of his application. <br /> <br />Maschka moved, Goedek seconded, that Joel and Phyllis Dillner <br />request for preliminary plat at 2192 Acorn Road be approved with <br />the following conditions: <br /> <br />1. That the lot line be moved to create the proper five foot <br />setback for the driveway. <br /> <br />2. That an easement be granted for utilities across Lot B. <br /> <br />3. That a drainage easement for the pond be granted. The pond <br />shall be maintained by the owner. <br />
