<br />Roseville Planning Commission Minutes <br />August 5, 1987 <br /> <br />Page 4 <br /> <br />Janisch pointed out the unique situation relating to the right- <br />of-way along County Road B, and the fact that the City was paying <br />the property owner (the owner owns the land that color Tile, <br />Rocky's and Burger King currently occupy). Through purchasing <br />the easement on County Road B, the City is also getting permanent <br />easements on the southern parcels along Snelling. The owner of <br />Rocky Rococo has also agreed to remove the impediments in the <br />rear of the parking lot to facilitate the private drive in the <br />back. <br /> <br />DeBenedet asked why the right-of-way simply wasn't being dedi- <br />cated. Janisch replied there is a very complicated agreement on <br />this site, based on the fact that the County didn't originally <br />pay for the facility; thus, it was fair for the City to purchase. <br />In addition, through the purchase, the city was also obtaining <br />the right-of-way along the Snelling Frontage. <br /> <br />Maschka asked for a clarification regarding the handicapped <br />parking which Tony Scardino, representing Burger King, proceeded <br />to explain. <br /> <br />Cushman asked whether Burger King has used similar drive-throughs <br />in the past. Scardino replied that they have used these and even <br />more complicated ones than the one proposed. <br /> <br />Johnson pointed out that the Burger King on County Road C <br />currently uses a loop. <br /> <br />Stokes asked how far the rear private road would go to the south. <br />Janisch replied that one could go all the way to Arby's. Stokes <br />asked why Rocky Rococo's was agreeing to this. Janisch replied <br />that the owner owns all three properties, plus the City could <br />have condemned the area and run a public road through the area. <br /> <br />Berry moved, DeBenedet seconded, that the Burger King Corporation <br />for variances at 2151 N. Snelling be approved with the following <br />conditions: <br /> <br />1. That the required easements be approved by Council prior to <br />issuance of building permits. <br /> <br />2. That a written agreement with Rocky Rococo be completed <br />regarding the 30 foot private drive. <br /> <br />3. That the development be constructed per plans dated June 3, <br />1987. <br /> <br />4. That the staff approve final engineering and landscape plans. <br /> <br />Roll Call, Ayes: <br />Nays: <br /> <br />Johnson, Maschka, Berry, Stokes, and DeBenedet. <br />None. <br />
