<br />ROSEVILLE PLANNING COMMISSION <br /> <br />Paget <br /> <br />3 <br /> <br />Wednesday, August 3, 1988 <br /> <br />Planning File 1873 <br /> <br />Deutsch/Jenkins request to vacate an unimproved portion of <br />Dellwood Avenue lying south of Oakcrest, north of willow Circle <br />and willow Lane, east of Hamline Avenue, and west of Fernwood <br />street. <br /> <br />Presentation <br /> <br />Dahlgren summarized the location and surrounding uses. Dahlgren <br />pointed out that utility and access to adjacent park area needs <br />to be maintained and that another option would be to grant a <br />property owner a variance to allow their proposed expansion. <br /> <br />Deutsch testified that the vacation request would allow him to <br />expand their home and that they would be willing to grant <br />easements to maintain access to adjacent park areas. <br /> <br />DeBenedet inquired what size of an addition they would like. <br />Deutsch responded that they would like approximately 500 sq. ft. <br />which would extend 16 to 20 ft. from the existing dwelling. <br />DeBenedet pointed out that the neighbors driveway appeared to be <br />in the right-of-way or very close to it. Deutsch indicated he <br />was not sure of the exact location. <br /> <br />stokes asked if all thirty feet would be needed. Deutsch replied <br />at the most, 20 ft. would be needed. Stokes asked if a 20 ft. <br />easement could be granted in the middle. Deutsch replied that <br />there would be no problem, that they maintain that area now. <br /> <br />Bierscheid testified that he had no obj ection to the proposed <br />addition, but wanted to make sure that the city's ability to <br />provide access into the adjacent park area is maintained. <br />Maschka asked if a 20 ft. wide easement is okay. Bierscheid <br />responded that 20 ft. may be okay for a path, but may not be <br />sufficient for utilities. <br /> <br />DeBenedet questioned maintenance responsibilities in the right- <br />of-way area. Deutsch pointed out that he and Mr. Jenkins jointly <br />mow the area now. <br /> <br />DeBenedet asked what setback requirements would be if the city <br />maintained ownership in the area. Dahlgren pointed out that a <br />30 ft. setback is required from a right-of-way, while a 10 ft. <br />setback would have to be maintained from the new lot line if the <br />right-of-way were vacated and an easement maintained. <br />
