Keel responded that a 20 ft. right-of-way or a <br />legal easement would be acceptable for utilities. <br /> <br />Johnson closed the public hearing. <br /> <br />Maschka asked if the city gets an easement can a path be put in. <br />Dahlgren responded that the city could get an easement which <br />specifically provided for maintenance and pedestrian and vehicle <br />access. <br /> <br />Maschka testified that it might be appropriate to delay action on <br />this matter to resolve the easement/right-of-way need question. <br /> <br />DeBenedet moved, Maschka seconded to table consideration of this <br />item until September 7, 1988 to allow staff to study city <br />easement/right-of-way needs to determine whether the right-of-way <br />can be vacated as requested. <br /> <br />Roll Call: <br /> <br />Ayes: <br /> <br />stokes, Maschka, Moeller, DeBenedet, <br />Berry, Johnson <br /> <br />Nays: <br />Planninq File 1877 <br /> <br />None <br /> <br />Brutger Companies request for Comprehensive Plan Change from <br />school to high density residential, and low density residential, <br />rezoning from R-l to R3-A, special use permit for a Planned unit <br />Development, and approval of a Preliminary Plat at 2400 North <br />Dale street. <br /> <br />Presentation <br /> <br />Johnson outlined the procedure which is being followed for review <br />of this project, and assured the audience that this project was <br />not being rushed through, but that the normal process any project <br />would have to go through is being followed. Johnson also pointed <br />out that the city did not institute this request, but that it was <br />instituted by the land owner. <br />
