Nisja stated that the <br />enclosed trash enclosure would have to be at least 5 feet away <br />from combustible roof line. <br /> <br />Johnson closed the public hearing. <br /> <br />Johnson stated that she was not in support of the rezoning and <br />that there had been no significant change from the proposal that <br />was turned down two years ago. Johnson stated that the developer <br />should work with the neighborhood and the city to develop an <br />acceptable proposal. <br /> <br />Maschka moved and Goedeke seconded to recommend rezoning the site <br />from B-3 to R-l and denying the special use permit. <br /> <br />The motion was withdrawn. <br /> <br />Berry stated that the proposal doesn't look any better than the <br />previous proposal. Berry stated that the residential <br />neighborhood is established and that housing should be developed <br />on the site. Berry suggested that during the upcoming <br />comprehensive plan revision that the site could be designated for <br />housing. <br /> <br />Goedeke moved and Maschka seconded to deny rezoning the site from <br />R-1 to B-3 based on the following findings: <br /> <br />1. The site is within an established residential neighborhood <br />and an appropriate use would be to remain R-1. <br /> <br />2. The rezoning would cause safety concerns including safe <br />ingress and egress into the site because the site is at the <br />intersection of five roads. <br /> <br />3. The proposal would result in litter in a residential <br />neighborhood. <br /> <br />4. The proposal would involve increase of odors into the <br />residential neighborhood. <br /> <br />5. <br /> <br />A petition <br />neighborhood <br />proposal. <br /> <br />and <br />has <br /> <br />statement by the <br />been submitted in <br /> <br />adjacent residential <br />opposition to the <br />
