Andert stated that if the water drains into the <br />neighbors yards that they should landscape to take that into <br />account. Keel stated that the onus falls on the property owner, <br />not the neighbor. <br /> <br />Hasek commented that this is only a lot split, drainage is a <br />separate issue. Hasek stated that all the property owner needs <br />to demonstrate is that the location and rate of drainage will <br />remain unchanged. <br /> <br />John Charles of 2418 Cohansey voiced his opposition to the split. <br />He stated that there would be no economic loss to the proposed <br />buyer if the lot split was denied, but 5 or 6 families could lose <br />value in their house if it were approved. <br /> <br />DeBenedet questioned where Mr. Charles lived. Charles showed his <br />property on the map. <br /> <br />Jeff Kaufman, of 2408 Cohansey, voiced his opposition to lot <br />split. He stated they were told that the land would remain <br />unsold. <br /> <br />Johnson commented that she was troubled that this <br />landlocked, however the promise made was an empty <br />developer didn't own the land in question. <br /> <br />parcel is <br />one, the <br /> <br />stokes commented that Bancon, the developer, should have never <br />made that promise since they didn't own the land. He stated that <br />the damage from drainage is a problem in the area. <br /> <br />DeBenedet commented that if this lot split meets ordinances and <br />policies, is consistent with other Commission decisions, and <br />engineering states there will be no drainage problem, then they <br />would have to approve it. <br /> <br />The Public Hearing was closed. <br /> <br />DeBenedet questioned whether there is a city storm sewer near <br />the lot. Keel stated that there was. <br /> <br />stokes questioned the types of site and building designs could <br />be used to help with drainage. Keel stated that roof design, <br />gutters and grading are important elements in the design. Keel <br />stated that site design could control the rate of run off which <br />is important. <br />
