A surveyor determined that the garage
encroached on the Owasso Boulevard South right-of-way. Shardlow
stated that staff has determined that the proposed vacation
would not affect traffic patterns.

Shardlow stated that since Owasso Boulevard South is a county
road, Ramsey County has the final say and that they don't want to
give up the right-of-way. Shardlow testified that he felt that
there was no problem with the vacation and that the City could
approve the vacation with a recommendation to Ramsey County for
approval. Mr. Fenner has indicated that he is in favor of this
proposal as well.

Fenner stated that they need the garage because their house lacks
storage space and they use the garage to store their possessions.

DeBenedet questioned whether Fenner will be back for a variance
on setback. Shardlow stated yes.

The public hearing was closed.

Goedeke moved and Roberts seconded to recommend approval of the
vacation with the condition that all required assessments be paid
and that a recommendation to vacate be forwarded to Ramsey County
to vacate the right of way.
