<br />ROSEVILLE PLANNING COMMISSION <br />Thursday, February 21, 1991 <br /> <br />Page 2 <br /> <br />Johnson asked if there was need for any further discussion in <br />light of the fact that the matter had been thoroughly discussed <br />at the Planning Commission meeting. <br /> <br />DeBenedet indicated that he was unable to attend the previous <br />hearing and questioned if there was any discussion, at the <br />previous meeting, concerning hours of trash pick up, deliveries, <br />and snow removal. Jopke replied that there was discussion at the <br />previous meeting in which the Tanurb had stated that the new <br />tenant would be subject to the same hourly limitations as is <br />currently in effect at the center. DeBenedet asked what the <br />specific hours were. Jopke stated that there could be no <br />deliveries, garbage pickups or snow removal between the hours of <br />10:00 p.m. and 7:00 a.m. <br /> <br />Berry stated that the neighbors behind the center are subject to <br />noise from trash pick ups, deliveries, and snow removals at all <br />hours of the night. Berry questioned the City Manager what else <br />could be done to properly enforce the ordinance. Berry pointed <br />out that there has been continual history of problems which may <br />get resolved after the fact but the neighbors still have to put <br />up with the noise. Berry stated that promises have continually <br />been made and not followed. <br /> <br />Sarkozy stated that this is a typical problem where you have <br />residential immediately adjacent to high activity commercial and <br />industrial areas. In these cases, the neighbors feel they are <br />entitled to quiet and reasonable use of their rear yards and at <br />the same time, the commercial properties feel they have a right <br />to properly utilize their properties. Sarkozy stated that, in <br />this case, that he felt that based on his discussions, Tanurb is <br />sincere in dealing with the neighborhood issues, and in fact have <br />agreed to cooperate on the fence issue, even though they <br />technically are not required to do so. <br /> <br />Mike Pedersen, 1790 Oakcrest, stated that the noise ordinance <br />states that they cannot pick up trash, make deliveries, or snow <br />removal between the hours of 10:00 p.m. and 7:00 a.m. on weekdays <br />and between 9:00 p.m. and 9:00 a.m. on weekends. <br /> <br />Johnson closed the public hearing. <br /> <br />MOTION <br /> <br />Roberts moved and Berry seconded to recommend approval of <br />Tanurb's request for amended special use permit for site plan <br />approval at 2480 N. Fairview Avenue with the following <br />conditions: <br />
