<br />ROSEVILLE PLANNING COMMISSION <br />Wednesday March 13, 1991 <br /> <br />Page 7 <br /> <br />Shardlow indicated that the nature of the agreement with the <br />property owner is such that the site will continue to be marketed <br />and when a permanent use is found for the site, then Mr. Brainard <br />has to leave. Shardlow added that the applicant would have no <br />vested rights in the site because of the granting of the interim <br />use permit. <br /> <br />David Gensmer, Mr. Brainard's representative, stated that Mr. <br />Brainard is extremely skilled and wants to establish a truck <br />repair business in the community. Gensmer pointed out that the <br />facility is perfect for Mr. Brainard's use. Gensmer added that <br />he would cooperate with the City on relocating and screening the <br />scrap steel storage area. <br /> <br />wietecki questioned whether there would be a maximum number of <br />trucks on the site established. Gensmer replied that they had <br />not established a maximum but the areas outlined on the plan <br />should be sufficient for storage of trucks. <br /> <br />Berry asked how trash handling and screening would be handled. <br />Gensmer answered that trash would be containerized and screened. <br />Gensmer also stated that they would be happy to improve the <br />appearance of the site by keeping weed growth down. <br /> <br />DeBenedet stated he would be concerned if there were two dozen <br />trucks on the site. DeBenedet also indicated his concern that in <br />light of the temporary nature of the use, would the applicant be <br />committed to properly maintain the site. DeBenedet stated that <br />applicants initially indicate their willingness to comply with <br />codes and then their promises melt away. DeBenedet said that for <br />him to be comfortable, there would have to be an agreed upon <br />maximum number of trucks and assurances would have to be made <br />concerning the care and upkeep of the site. <br /> <br />Shardlow testified that the process is basically the same as for <br />a special use permit and that there is a total range of <br />opportunities to attach conditions to the approval to guarantee <br />performance including performance bonds or letters of credit. <br />Shardlow said that the Planning Commission could articulate the <br />level of assurance that they are comfortable with and recommend <br />that the Council direct staff to work out details. Shardlow <br />stated that the issues which the Planing Commission should be <br />looking at are if the proposed use is okay on the site and what <br />level of assurance is necessary from the applicant concerning use <br />and maintenance on the site. <br /> <br />Goedeke pointed out his concern about the use of the site because <br />it is a gateway to the area to the south. Goedeke added that all <br />truck repair uses he has observed are noisy and could adversely <br />affect the existing office uses in the area.
