<br />CITY OF ROSEVILLE PLANNING COMMISSION MEETING <br />WEDNESDAY, FEBRUARY 8, 1995 <br /> <br />approved. Mr. Rich stated that Mr. Kath's proposal meets the criteria of the one <br />sentence requirement for a night watchman's residence. It is the uniqueness of the <br />proposal that the Commission is struggling with. An empty building needs more <br />security than a full building. The ordinance allows the occupation of the building <br />to protect it. There is no intention to have the watchman carry a gun. <br /> <br />Member Thomas explained that the city does not have a definition of "residence" <br />and "watchman". <br /> <br />Mr. Rich stated that his definition of "night watchman" is "a presence" in the <br />building. <br /> <br />Chairman Wietecki clarified that the Planning Commission is trying to understand <br />the mix of retail and residential uses. The Commission does not understand the <br />Kath proposal -- Is it a mixed use development or a commercial development and <br />a residence? <br /> <br />Member Wall stated the Planning Commission needs to provide more direction <br />than a one sentence definition. <br /> <br />Member Harms explained that Mr. Kath states he wants to live at the site. This <br />will be his residence; not a night watchman's residence. <br /> <br />Commission members requested that staff forward their thoughts and concerns <br />regarding this appeal issue to the City Attorney and City Council. (See Motion <br />under 6 (d-2). <br /> <br />6. (d-2) Kath Special Use Permit (S.U.P.) <br /> <br />Mr. Rich stated the S.U.P. for a leasing operation is 1400 S.F. with 5 display <br />automobiles which would be shown to leasers by appointment. There would be <br />strictly indoor display for lease returned vehicles shown and sold by Mr. Kath. <br /> <br />Member Wall stated that the district is appropriate for leasing of vehicles by <br />S.U.P. the S.u.P. does/can have conditions. Member Wall listed the criteria for <br />review and approval. <br /> <br />Member Thomas noted that north of this site, across the street, is a church and <br />residential area. The other buildings are 8 to 5 p.m. businesses. <br /> <br />14 <br />
