CITY OF ROSEVILLE PLANNING COMMISSION MEETING WEDNESDAY, FEBRUARY 8, 1995 approved. Mr. Rich stated that Mr. Kath's proposal meets the criteria of the one sentence requirement for a night watchman's residence. It is the uniqueness of the proposal that the Commission is struggling with. An empty building needs more security than a full building. The ordinance allows the occupation of the building to protect it. There is no intention to have the watchman carry a gun. Member Thomas explained that the city does not have a definition of "residence" and "watchman". Mr. Rich stated that his definition of "night watchman" is "a presence" in the building. Chairman Wietecki clarified that the Planning Commission is trying to understand the mix of retail and residential uses. The Commission does not understand the Kath proposal -- Is it a mixed use development or a commercial development and a residence? Member Wall stated the Planning Commission needs to provide more direction than a one sentence definition. Member Harms explained that Mr. Kath states he wants to live at the site. This will be his residence; not a night watchman's residence. Commission members requested that staff forward their thoughts and concerns regarding this appeal issue to the City Attorney and City Council. (See Motion under 6 (d-2). 6. (d-2) Kath Special Use Permit (S.U.P.) Mr. Rich stated the S.U.P. for a leasing operation is 1400 S.F. with 5 display automobiles which would be shown to leasers by appointment. There would be strictly indoor display for lease returned vehicles shown and sold by Mr. Kath. Member Wall stated that the district is appropriate for leasing of vehicles by S.U.P. the S.u.P. does/can have conditions. Member Wall listed the criteria for review and approval. Member Thomas noted that north of this site, across the street, is a church and residential area. The other buildings are 8 to 5 p.m. businesses. 14
