<br />City of Roseville <br />Planning Commission Minutes <br />July 12, 1995 <br /> <br />Mr. Jim Nelson, representing Brick Oven Beanery Restaurants, summarized the history of <br />the restaurants on the site and stated that they previously did not feel that a small <br />encroachment was a problem. However, current attorneys are taking a different, more <br />conservative, view. Therefore, they are requesting that the variance be granted to clear up <br />the title problem. <br /> <br />There were no public comments. Chairman Wietecki closed the public hearing. <br /> <br />MOTION: Chairman Wietecki moved and Member Sandstrom seconded to <br />recommend approval of Beaneries of the Midwest, Inc. c/o Discus <br />Acquisition Corporation's request for a variance to the zoning ordinance at <br />2720 North Snelling Avenue. <br /> <br />ROLL CALL: <br /> <br />Ayes: Wall, Sandstrom, Thein, Rhody, Harms, Wietecki <br />Nays: None. <br /> <br />The Planning Committee Meeting recessed at 9:00 p.m. and reconvened at 9:16 p.m. <br /> <br />6. <br /> <br />(e) <br /> <br />Planning File 2777: Daniel Oren's request for a variance to the shoreland <br />ordinance at 367 South Owasso Boulevard. <br /> <br />Chairman Wietecki opened the public hearing and requested Michael Falk to provide a <br />background report. Planner Falk with the aid of a video explained the existing site, and <br />showed a relationship to the surrounding single-family dwellings and the lake. Mr. Falk <br />also highlighted the series of permits that have been issued on the site. Mr. Falk pointed <br />out city staff originally approved a building permit to allow the remodeling and <br />expansion away from the lake of the existing cabin on the site. The original structure was <br />located 37 feet from the Lake Owasso shoreline instead of the required 75 feet and it also <br />had a 0 foot sideyard setback instead of the required 5 foot. The staff interpreted that the <br />structure could be expanded as long as the substandard distance to the lake was not <br />reduced. <br /> <br />9 <br />
